103. The International Covenant on Civil and Political Rights, the European Convention on Human Rights and the American Convention on Human Rights specify clearly which fundamental human rights may not be suspended or restricted.

Protocol no. 12 to the European Convention for the Protection of Human Rights and Fundamental Freedoms (ECHR) provides for a broader basis for the ban on discrimination contained in the Convention.

European Convention on the Adoption of Children

For this reason, and in order to protect the interests of the European Union, the Member States agreed to the Protocol drawn up on the Basis of Article K.3 of the Treaty on European Union to the Convention on the Protection of the European Communities Financial Interests.

The right to privacy and to judicial protection against arbitrary or unlawful interference with that right are guaranteed in article 17 of ICCPR and in article 11 and article 8 of the American Convention and the European Convention, respectively.

However, at the same time it declared that it would apply the Convention in relations with the States parties to the European Convention on Extradition, opened for signature at Paris on 13 December 1957, provided that the Organized Crime Convention supplemented and facilitated the application of the provisions of the European Convention.

Similarly, the provisions of the Convention on the Rights of the Child and those of the Council of Europe have been taken into account.

Equally, member States are bound by the European Convention and their actions are submitted to the supervision of the European Court of Human Rights.

Forthcoming also is the signing of the Convention on the Protection of the European Cultural Heritage.

Its founding instrument is the European Convention on Human Rights, 1950.

This Protocol will enter into force when all the States Parties to the European Convention on the Suppression of Terrorism (ETS No. 090) have ratified it.

A similar possibility exists in relation to the European Convention on Human Rights.

8.5 However, the European Court was able to examine the same matter only insofar as the substantive rights protected under the European Convention converge with those protected under the Covenant, and to the extent that the events complained occurred prior to 18 May 1999, when the author filed his application with the European Court.

It had become party to the Optional Protocol to the International Covenant on Civil and Political Rights in 1988 and to the Convention for the Protection of Human Rights and Fundamental Freedoms and the Additional Protocols thereto in 1992.

Conventions and Protocols within the Council of Europe

For example, a number of Member States contested the ability of the EC to join the European Convention on Human Rights before the European Court of Justice.

The European Convention limits its selection to these rights, while the International Covenant on Civil and Political Rights and the American Convention extend non derogabilty to the right to recognition as a person before the law and to freedom of conscience and religion.

She also referred to the European Commission on and Court of Human Rights, which had indicated that the fulfilment of the rights provided for in the European Convention on Human Rights entail an obligation for the State to take positive measures to allow persons belonging to a particular group to exercise their rights.

8. Welcomes further the major contribution of the Council of Europe to the Stability Pact for South Eastern Europe, launched at the initiative of the European Union, and to the development of regional projects to support its aims

That formulation corresponds to the one found in the European Union Convention on Insolvency Proceedings (art. 3 of that Convention).

The company claimed that there was no substantial reason for it to be included on the list, and that its inclusion violated the European Union Treaty, the European Convention on Human Rights (the right to property and the freedom of economic initiative) and the Italian Constitution.
