Euratom Treaty Chapter VII Safeguards and Commission Regulation (Euratom) No. 302 2005 provide the national legal framework for the accounting of production, use and storage of civil nuclear materials.

Lithuania is subject to IAEA and EURATOM safeguards.

Rather, its component communities the European Community (EC) and the European Atomic Energy Community (Euratom) have traditionally performed such functions.

The European Community also declared that the Convention would apply, with regard to the competence of the Community, to the territories in which the Treaty establishing the European Community, as amended by the Amsterdam Treaty, was applied and under the conditions laid down in that Treaty, in particular its article 299.

European and international supervision of nuclear material is made by the EU Commission and the IAEA (Euratom Treaty, INFCIRC 193).

Since the accession of Lithuania to EU, the accounting and control of nuclear materials has been regulated by the European Commission's Regulation on the Application of European Atomic Energy Community (EURATOM) Safeguards.

Upon accession to the European Union in 1995, the safeguards agreement between the European Atomic Energy Community (EURATOM), the European Union non nuclear weapon States and IAEA entered into force for Austria and the 1972 safeguards agreement was suspended.

These Territories have been included in the Treaty establishing the European Community since the accession of the United Kingdom on 1 January 1973.

A strategy countermeasures compendium, developed with support from the research programme on nuclear energy of the European Atomic Energy Community, contains countermeasures that have been assessed against a common set of criteria.

The Treaty on the European Community, article 39, establishes five targets for this agricultural policy.

The European Court of Human Rights had no jurisdiction to pronounce on acts of the European Community as the Community was not a party to the Convention.

III. EUROPEAN COMMUNITY

To fulfil that requirement with regard to the Treaty Poland is obliged to replace its bilateral safeguards agreement and its additional protocol with a trilateral agreement and protocol between European Atomic Energy Community, the non nuclear weapon States of the European Union and IAEA, thus suspending the provisions of the bilateral legal instruments.

The European Commission, as custodian of the Treaty establishing the European Community and the Community rules derived therefrom, was required to ensure compatibility between the draft convention and Community rules, in particular Directive 2000 31 EC on electronic commerce.

Indeed there was a legal obligation on member States under European Treaty rules not to breach Community law.

In their mutual relations, Parties which are members of the European Community shall apply the relevant Community rules instead of articles 15 and 18.

After Lithuania became a member of the European Union in May 2004, a transition from a bilateral safeguards agreement with IAEA and its Additional Protocol to the trilateral ones between the EU non nuclear weapon States, EURATOM and IAEA was required.

These common positions and Council regulations are binding on States members of the European Union.
