Europe s High Court Confronts Racism

Questions of responsibility of the European Community for conduct held by member States were discussed by the European Court of Justice.

For example, a number of Member States contested the ability of the EC to join the European Convention on Human Rights before the European Court of Justice.

The effectiveness of that remedy had been recognized by the European Court of Human Rights.

If such were the case, the protection regime established by the Convention would be weakened significantly.

Equally, member States are bound by the European Convention and their actions are submitted to the supervision of the European Court of Human Rights.

The State party requests the Committee to endorse the European Court's case law in this regard.

Violations of those provisions could be addressed in the national courts and tribunals and ultimately referred to the European Court of Justice.

2.7 The first author submitted a complaint to the European Court of Human Rights.

The authors had demonstrated that they were individuals distinct from the three sets of parents who filed a complaint with the European Court, and had chosen not to submit their cases to the Court.

Professor Schrijver provided an international law perspective on sanctions and commented on two sanctions related cases that had been before the European Court of Human Rights and the European Court of First Instance.

The European Court of Human Rights had no jurisdiction to pronounce on acts of the European Community as the Community was not a party to the Convention.

12.21 Before the European Court, the applicants claimed that Turkey had violated, inter alia, article 3 of the European Convention.

The Government signed the European Convention for the Protection of Human Rights and Fundamental Freedoms and its Protocols, thereby accepting the competence of the European Commission and European Court of Human Rights.

23. Other international courts and tribunals, including the European Court of Human Rights and the Inter American Court of Human Rights, are invited to disseminate more widely their judgements and advisory opinions and to consider preparing thematic or analytical summaries thereof.

A claim brought by Prince Hans Adam II before the European Court of Human Rights concerning the decisions by the German courts was also dismissed.

Moreover, their claim regarding the IG Farben shares was not examined by the European Court at all.

The European Union commends the Court for its outreach activities in the field, which are carried out in relation to those cases.

The pending Bosphorus case before the European Court of Human Rights may provide an illustration.

The second part reviews developments that have taken place at the regional level, with a particular reference to the work of UNECE and the jurisprudence of the European Court of Human Rights.

The most important example is constitutional courts a different animal from the US Supreme Court, and one specifically tasked with ensuring respect for individual rights. Eventually, even countries traditionally suspicious of government by judges France being the classic case accepted this model of constrained democracy.

In this connection, the State party also mentions the jurisprudence of the European Court of Human Rights and Canada.

The authors allege before the Committee that the present communication is different from the case examined by the European Court, for two reasons first, the second author did not apply to the European Court secondly, the Court did not recognize the first author's right to bring an action and dismissed the application without considering the case on the merits.
