The status, privileges and immunities of the Organization, of its Executive Director, its staff and experts, and of representatives of members while in the territory of Japan shall continue to be governed by the Headquarters Agreement between the Government of Japan and the International Tropical Timber Organization signed at Tokyo on 27 February 1988, with such amendments as may be necessary for the proper functioning of this Agreement.

In 1946, the General Assembly adopted the Convention on Privileges and Immunities of the United Nations (the General Convention), which establishes the detailed privileges and immunities needed by the United Nations.

The Headquarters Agreement grants to officials and representatives to the COP the privileges and immunities granted to United Nations officials and representatives of Members to the United Nations under the General Convention.

The parliamentary resolutions to ratify the Conventions on the Privileges and Immunities of the United Nations and the Specialized Agencies were also approved by the National Parliament on 19 July.

In any case where an issue arises regarding the application of these privileges and immunities, the staff member shall immediately report the matter to the Secretary General, who alone may decide whether such privileges and immunities exist and whether they shall be waived in accordance with the relevant instruments.

These agreements, even in the absence of a complete regime of privileges and immunities, would help provide privileges and immunities to members of constituted bodies.

In the view of UNRWA the charge is a tax from which United Nations agencies should be exempted by virtue of the immunity from taxation granted by the Convention on the Privileges and Immunities of the United Nations.

The Centre for Human Rights notified the solicitors for the claimants, by letter dated 22 December 1995, of the Special Rapporteur apos s immunity from legal process under the Convention on Privileges and Immunities of the United Nations (1946).

Those immunities and privileges were thus reaffirmed as currently codified in international law.
