The rationale for including the construction period in the total concession period is to encourage the project company to complete the construction works ahead of schedule, so as to benefit from a longer period of concession.

Here, too, it might be desirable to limit the withdrawal of the concession during its operation to particularly serious circumstances.

Many national laws limit the duration of the concession to a maximum number of years, which sometimes expressly include the construction period, as well as any extension given for reasons of force majeure.

Some laws authorize one or more extensions of the concession period for an equal or shorter term, while other laws generally prohibit extensions, save for exceptional conditions, such as to allow the project company to recover the cost of extraordinary work required to be done on the facility.

If special leave to appeal were granted, a three week period from the granting of special leave to appeal would apply for the filing of the notice of appeal.

It was observed that the right of the host Government to purchase the concession from the concessionaire presented another possibility for dealing in a flexible manner with the duration of the concession.

Limitations on the extension of the concession period are sometimes provided as a protection for the host Government against demands by the project company.

A similar restriction should exist as regards the right of the host Government to approve the granting of a subconcession by the concessionaire (para. 37).

There also appears to be no limit on the amount of 150,000 hectare concessions that may be granted, which is especially troubling given that front companies have been used to circumvent restrictions on concession size in the past.

If the execution of the project is interrupted as a consequence of a governmental act, the project company may be entitled to an extension of the concession period as well as compensation for the damage it sustained.
