Article 88.2 is, according to one opinion, unnecessary.

The drafting according to one opinion is not satisfactory in article 88 (see another proposal Part IV, article 88, alternative 2).

It was observed that the proposed text of draft article 88a (6)(b) represented a compromise position between, on the one hand, excluding the application of contractual derogations to the draft instrument to third parties and, on the other hand, applying these contractual stipulations to third parties without limitation.
