Following the proposal of the Tribunal concerning reimbursement of national taxes, the fourteenth Meeting of States Parties approved the inclusion, in the budget of the Tribunal, of budget lines to reimburse members and officials of the Tribunal for national taxes levied on their remuneration paid by the Tribunal pending the outcome of negotiations on the conclusion of a bilateral tax reimbursement agreement.7

Any further budget proposal would reflect liquidation requirements to take the Court through its completion.

4. His delegation supported the conclusions and the budget recommendations of the Advisory Committee on Administrative and Budgetary Questions (ACABQ) on the two Tribunals.

The high levels of outstanding assessed contributions for the regular budget of the Organization and the considerable negative cash position of the International Tribunals, which stood at 80 million as of 15 October 2004, were cause for concern, as was the fact that 113 countries had outstanding assessed contributions for the budgets of one or both of the Tribunals.

The balance of unpaid contributions with respect to the overall budget of the Tribunal amounted to 2,581,150.

As has been emphasised by previous Presidents of this Tribunal, these three fugitives in particular cannot wait the Tribunal out.

May I further emphasize that parties may at any time conclude a special agreement to submit a dispute to the Tribunal or to an ad hoc special chamber of the Tribunal, in accordance with article 15, paragraph 2, of the Statute.

The 2005 budget was approved by the territorial Congress. The centrepiece of the budget was an increase in the official minimum monthly wage to CFP110,000 (around 1,200) from CFP100,000.

The Tribunal simply cannot close its doors until these fugitives have been tried.

The Advisory Committee commends the International Tribunal for the Former Yugoslavia and the International Criminal Tribunal for Rwanda for presenting a logical results based budgeting framework that is well structured, both qualitatively and quantitatively.

The pension benefit for the judges of the International Tribunal for the Former Yugoslavia and the International Criminal Tribunal for Rwanda, would be based on that applicable to the judges of the International Court of Justice, prorated to account for the difference in length in the terms of appointment, that is to say, nine years for the members of the International Court of Justice versus four years for the judges of both tribunals.

This included an amount of 2,633,220 from savings in the 1998, 1999 and 2000 budgets of the Tribunal.
