The representative of the secretariat drew the attention of the Conference to decision RC 1 14, which requested the secretariat to operationalize the regional delivery of technical assistance to Parties.

The author appealed against this decision as well in January 1997, this appeal was also dismissed, on the ground that the Government had, by its decision of September 1996, finalized the examination of the matter and therefore concluded the proceedings.

The author applied for judicial review of this decision.

In its decision 2005 104, the Commission endorsed that request.

Accordingly, the Working Group decided to consider the present request as admissible.

The Committee s attention was drawn to the draft decision, which had been submitted by the Chairman.

The request for nullity was rejected by the court and the appeal on cassation was not resolved within the period of 30 days established by law.

This consolidated draft decision will invite the COP MOP to confirm and give full effect to decisions 21 CP.8, 18 CP.9 and 12 CP.10 and the annexes attached to these decisions.

16. The Committee decided to draw the General Assembly s attention to paragraph 28 of its decision 34 401, to paragraph 6 of its resolution 48 264 and to paragraph 4 of its resolution 50 206 C. The Committee also decided to draw the Assembly s attention to paragraph 32 of the annex to resolution 51 241.

At the request of the representative of the United States of America, a recorded vote was taken on the draft decision, which was adopted by 51 votes to 2.
