The division of joint property

The parties themselves determine the makeup of the property (excluding the personal property of each).

Regarding the administration of the couple's assets, Law will hand this over to the husband, except where there exists a separation of goods regimen.

The common property of the spouses may be divided between the spouses with their agreement. In the event of a dispute, the court divides the common property of the spouses and determines the spouses' shares of that property.

However, in the case of common ownership by a couple, there is a possibility to deduct tax at a rate corresponding to half of the total income of the couple (splitting system).

The petition for the dissolution of the marriage, as a rule, addresses the issue of the division of the common property of the spouses, the maintenance obligations (with regard to the spouse and to the children), and with which of the spouses the children will live.

Unto the men (of a family) belongeth a share of that which parents and near kindred leave, and unto the women a share of that which parents and near kindred leave, whether it be little or much a legal share.
