Senior bank managers would be paid not in cash or equity, but in the bank s long term bonds, thereby giving them a larger financial stake in the bank s long term stability, instead of its long term stock price. My proposal is to use the European Financial Stability Facility (EFSF) and the European Stability Mechanism (ESM) to insure the European Central Bank against the solvency risk on any newly issued Italian or Spanish treasury bills that it may buy from commercial banks. This would allow the European Banking Authority to treat these various T bills as the equivalent of cash, because they could be sold to the ECB at any time.

The list of the designated commercial banks shall be determined and publicly announced by the securities regulatory agency under the State Council jointly with the banking supervision and management organs of the State Council.

At the same time, commercial banks were no longer required by the Central Bank to mandatory subscription to treasury bills in February 1997 (the requirement was at least 40 per cent of their deposits).

Thus, there is systemic market risk, and unregulated securitization of banking assets, which was the main cause of the recent collapse, adds to it. To avert a repetition, securities held by banks must carry a much higher risk rating than they currently do.

The application of funds of an insurance company is limited to bank deposits, trading of government and financial bonds and other forms of fund application stipulated by the State Council.

The ECB has already attempted to ease credit conditions by purchasing high quality asset backed securities. It has bought securities backed by cash flows from private sector mortgages, so called covered bonds, and it has floated the idea of buying corporate bonds and multilateral securities issued by the European Investment Bank.

Among other things, Basel III stipulates that banks do not have to set aside cash against their investments in government bonds with ratings of AA or higher. Moreover, investments in bonds issued by their home governments require no buffer, regardless of the rating.

Article 50 A securities firm that carries out securities lending and borrowing business shall sign a securities lending and borrowing contract with the customer, and shall open a customer securities guarantee account with the securities registration and settlement organs, and a customer funds guarantee account with the designated commercial bank in the name of the securities firm in accordance with the provisions of the securities regulatory agency under the State Council.

Moreover, not forbidding indirect purchases should be seen primarily as a means of permitting banks that buy government bonds to pledge them as collateral for refinancing operations, while bearing the full investment risk. The distinction between bond purchases from the government and from the banks that bought them from the government is a phony one that gives rise to myriad possibilities for circumvention.

The securities regulatory agency under the State Council can enquire the bank accounts of a securities firm and enterprises controlled or actually controlled by the securities firm with approval of a person responsible of the securities regulatory agency under the State Council with a view to make a thorough investigation of business and financial status of the securities firm.

Germany s consent was needed to create Europe s banking union, which entailed the transfer of supervisory powers to the European Central Bank and the creation of a common fund to resolve failing banks. And German resistance contributed to a delay in the ECB s intervention in bond markets when the ECB finally did launch its bond buying program, it did so with Germany s tacit approval.

Under the first, more developed proposal, banks would undertake large obligations via long term bonds, which would be paid only if their operations are sound. In effect, the long term bondholders would guarantee the rest of a bank s debts, including the riskiest ones.

These countries have little access to bond markets and to medium to long term commercial bank lending.

In 2012, American prime money market funds, which buy bank and corporate debt, were worth nearly 1.5 trillion. The money flowing through these funds went to many of the world s largest banks, including not just the obvious US suspects (JP Morgan Chase, Bank of America, and Citi), but also major European and Japanese banks such as Barclays, Deutsche Bank, Bank of Tokyo, Sumitomo, Credit Suisse, and ING.

Restructuring gives banks a chance for a new start new potential investors (whether in equity or debt instruments) will have more confidence, other banks will be more willing to lend to them, and they will be more willing to lend to others. The bondholders will gain from an orderly restructuring, and if the value of the assets is truly greater than the market (and outside analysts) believe, they will eventually reap the gains.

It also reflects the flight of portfolio funds and short term bank lending, the latter having caused major banking and corporate liquidity crises in the countries losing the funds.

Mortgage banks kept some claims on their books, but sold most of them to investment banks as mortgage backed securities. The investment banks blended these securities into asset backed securities and collateralized debt obligations (CDOs) and sold them on to financial institutions throughout the world.

Like the World Bank, United Nations budget assessment payments are obligations of Member States, and accordingly United Nations obligations (i.e., the bond issue) would probably be eligible to be defined as quasi sovereign.

As a result, mortgage brokers maximize their income by generating larger volumes of mortgages, as do the banks that package these loans into mortgage backed securities (MBS s). Investment banks then earn fees for re packaging these securities in tranches of collateralized debt obligations, or CDO s (and sometimes into CDO s of CDO s).

Individuals, banks, and financial trade institutions should be legally responsible to make reports on the transfer of large amounts of cash and financial documents overseas.
