Indigenous claims have generally been negated by applying various versions of the principle of terra nullius.

Paragraph (2) made it clear that the principle of non discrimination embodied in paragraph (1) did not affect the provisions on the ranking of claims in insolvency proceedings, including any provisions that might assign a special ranking to claims of foreign creditors paragraph (2), however, provided a minimum ranking for claims of foreign creditors.

Explicit provision should be made for that principle.

Provision is made for miscellaneous claims and adjustments ( 50,000).

75. Claims and adjustments. Additional requirements of 114,400 under claims and adjustments relate to claims in respect of damages incurred as a result of traffic accidents not covered by local insurance. No provision was made for this purpose in the cost estimates.
