In cases of partial permanent incapacity the pension paid will be a percentage of that payable in respect of permanent total incapacity.

4.3 In this context, they explain that the Exceptional Incapacity Allowance, which is granted to veterans who suffer from extraordinary incapacity, is only available for persons who have a full pension under the Pension Act.

5.5 A veteran who receives the maximum war disability pension may also be awarded an additional Exceptional Incapacity Allowance.

The pension is equivalent to 40 of the pension which would have been payable to the insured person in respect of permanent total incapacity, but may not be less than the minimum widow's pension payable under the invalidity and life insurance scheme.

Since the Veterans Pension Act does not recognize the Hong Kong veterans prisoner of war benefit as a form of pension for the purpose of the Exceptional Incapacity Allowance, the Hong Kong veterans cannot qualify, although the majority would meet the other requirements for the allowance.

This is the cash benefit awarded to the widow(er) or concubine financially dependent on an insured person where the death of the latter was due to an occupational hazard or the deceased was receiving a pension in respect of total or partial incapacity for work.

311. For individual farmers the rate of the maternity allowance (from 1 January 1991) is equal to eight weeks apos sickness allowance (the sickness allowance is payable at the rate of one thirtieth of the basic old age pension for every day of incapacity for work).

This limitation does not apply to incapacity for work as the result of an accident.

If the orphan has lost father or mother, the amount of the pension will be 20 of the amount which would have been awarded to the insured person in the event of permanent total incapacity, and will be increased to 30 in the event of the death of the other parent.

This is a cash benefit awarded to each of the financially dependent children of an insured person who dies of a non occupational accident or illness or while receiving a pension in respect of permanent total or partial incapacity for work and or on the death of the spouse or concubine.

The Pension Fund indicates that it is looking for a comparable pension fund and will review the practices of other pension funds.

Only persons who are employees of the founders of pension funds may be participants of pension plans of the closed pension fund.

Nevertheless, other grounds for total or partial exemption are provided for, notably incapacity of a physical, moral and social nature, together with proof of such incapacity, in article 10 of the Military Service Act and chapter V of the regulations relating thereto.

The third tier of the pension system is the voluntary private pension scheme, i.e., private pension funds, where everyone can participate and accrue additional resources for his her pension in old age.
