Policy, Regulatory Frameworks and Equitable Benefit Sharing

First, there are legislative and regulatory measures.

If banks are regulated at the national level, but do business internationally, national regulatory authorities have a permanent incentive to set lax standards to avoid driving business to other countries and to lure it from them instead. Regulatory competition thus degenerates into a race to the bottom, since the benefits of lax regulation translate into profits at home, while the losses lie with bank creditors around the world.

Among other things, the Decree provides that the health and safety of individuals must be adequately protected, and to that end the production, sale, transport, possession and use of radioactive materials or equipment emitting ionizing radiation must be in conformity with the regulatory standards and safeguards established by the Decree and contained in the code of standards that make up the Radiological Protection System.

But the erosion of traditional law remains most pronounced in the international arena. The G 20 s decisions have become increasingly informal, while rule making authority has been outsourced to private regulatory bodies, such as the Basel Committee and the International Accounting Standards Board.

Indeed, it is even more difficult than reaching trade agreements, which must cover issues like tariffs, quotas, quality standards, regulatory regimes for particular sectors, and relevant microeconomic issues. Merging all of these challenging topics into a single negotiation process is a recipe for deadlock.

Having said this, there would be immediate upside potential, owing to better resource allocation, more harmonized investment regimes, stronger standards, and the elimination of outdated non tariff and regulatory barriers. Aerospace, auto manufacturing, biotechnology, cosmetics, and pharmaceuticals are among the sectors that stand to gain.

Suppliers in some countries already have been asked to report any suspicious purchases, limit the quantities sold to individuals, and to increase the security of their stocks but adoption and monitoring of regulatory standards is necessary to ensure uniform application of such security measures.

The focus has thus gradually shifted away from border measures towards domestic policies which have a trade and investment impact such as subsidies, standards, customs procedures, regulatory policies, the development of rapid and cost effective transport systems etc, the socalled behind the border agenda.

To build and strengthen national regulatory, institutional and human capacities to overcome barriers to trade, and to meet voluntary and mandatory standards and conformity assessment procedures to be able to access external markets and improve the protection of consumers and the environment in internal markets

It must be recognized that regulatory reform entails adjustment costs and necessitates regulatory capacity and institution building, technical assistance and capacity building in this regard.

And it has no rules to its regulatory system.
