Why this atrocity?

The strain on Syria s neighbors is immense, and the conflict is inexorably seeping into the wider region. Both government and rebel forces have committed atrocity crimes.

It went to the length of committing the bestial atrocity of massacring them by the cruelest methods because it was fearful of the possible exposure of its barbarous crimes to the public.

And I thought, after all this atrocity, this is how human beings really pray.

In July, the European Union again suffered the horror of a major terrorist atrocity.

We paid solemn tribute to the millions of innocent victims of that unspeakable atrocity.

The basic problem is that the Islamic State s territorial gains are being approached from three completely different perspectives, demanding three different types of operational responses. There is the humanitarian mission to protect civilian populations in Iraq and Syria from mass atrocity crimes.

I spent the better part of a decade looking at American responses to mass atrocity and genocide.

The moral argument that the veto should not be used in cases of mass atrocity crimes is overwhelming. The P5 have obligations under the UN Charter, as well as international humanitarian and human rights law, not to undermine the effectiveness of the UN or that body of law.

The crimes are basically crimes against humanity

If they do, it should not be viewed as a rearguard action designed to undermine the R2P norm, but rather an effort to assume co ownership of it. In terms of getting serious about saying never again to mass atrocity crimes, that is about as positive a development as anyone could hope for.

This conviction lies behind the establishment of international humanitarian law and the supranational courts that address violations of it. And it underpinned the adoption of the responsibility to protect principle, which demands that the international community defend a country s people from mass atrocity crimes when their own government fails to do so.

It is too late now for non military tools of coercion to have much effect, although Security Council threats of International Criminal Court prosecution for atrocity crimes including any use of chemical weapons must remain on the table . But what of the military response options still strongly favored by many policymakers and pundits?

You have no common crimes? Only political crimes.

I have learned from long experience that to be optimistic about almost anything in international affairs is to run the risk of being thought ignorant or naïve, if not demented. But, on the issue of mass atrocity crimes where the international community has long had good reason for shame real optimism is now justified.

C. Relationship between international crimes and crimes against international law

Since it is limited to politically motivated crimes, to the exclusion of the crimes of genocide, crimes against humanity and war crimes, the provisional immunity cannot be a bar to investigation into any of those crimes.

Thus it may be said that international crimes are always associated with crimes against international law, but crimes against international law are not necessarily associated with international crimes.

These recommendations included the appointment of exclusive special courts where the magnitude of atrocity cases is growing and a training programme for police and civil servants.

There are new categories of crimes such as crimes involving national defence management (chap. 4) and crimes against socialist culture (chap. 6).

The competence of the court should cover four categories of crimes genocide, crimes against humanity, war crimes and the crime of aggression.

Quite often the expressions crimes against international law , crimes under international law and crimes of an international nature are regarded as synonymous.

The material (subject matter) scope of the provisional immunity extends to politically motivated crimes although those crimes remained largely undefined from which genocide, crimes against humanity and war crimes were explicitly excluded.

Chapter VII, VIII, IX and X refer to crimes endangering the interests of national defence, crimes of graft and bribery, crimes of dereliction of duty and crimes relating to military personnel, respectively.

PARIS Back in 2001, France floated a proposal that the five permanent members of the United Nations Security Council (P5) should voluntarily refrain from using their veto power when dealing with mass atrocity crimes. And now, in the lead up to the commemoration of this year s 70th anniversary of the UN, French President François Hollande s government is actively pursuing the idea again.
