Proposed study and colloquium

In November 2004, the Office of the Prosecutor hosted a successful colloquium of prosecutors of international criminal tribunals.

The aim of the colloquium was to discuss common problems, share ideas and solutions and adopt best practices.

A total of twelve judicial officers from eight countries (Bolivia, Brazil, Colombia, Cuba, Mexico, Paraguay, Peru and Uruguay) attended the colloquium.

The theme of the Colloquium, to which he was invited by Conectas Human Rights and Sur Human Rights University Network, will be South South dialogue to strengthen human rights .

His delegation welcomed the discussion by the Commission of future work on insolvency law and would be pleased to take part in the colloquium to be held in November 2005.

The colloquium will bring together members of NHRIs, the judiciary, parliamentarians, NGOs, Government and the media to discuss strategies relating to implementation of treaty body recommendations at the national level.

Emphasizing the importance of the matter and the need to consult with representatives of the relevant industry and practice, the Commission recommended that a two to three day colloquium be held.

In conjunction with the thirty third session of the Commission in 2000, a transport law colloquium, organized jointly by the secretariat and CMI, was held in New York on 6 July 2000.

INSOL is willing to join with UNCITRAL in promoting the study and the discussion at a multinational colloquium to be convened in advance of a possible decision to establish a Working Group.

That consultation might take the form of a multinational colloquium, a forum used to good effect in developing both the Model Law on Cross Border Insolvency and the Legislative Guide on Insolvency Law.

In addition to the aforementioned missions to Tajikistan and Kyrgyzstan, the Special Rapporteur plans to participate in the fifth International Human Rights Colloquium, to be held in São Paulo, Brazil, from 8 to 15 October.

Also within the framework of the EU funded project, the NI Unit, in conjunction with the Treaties and Commission Branch, are organizing a judicial colloquium to be held in the African Region in October 2005.

The judicial colloquium was facilitated by a former member and chairperson of the Human Rights Committee, who was at that time a judge of the Inter American Court of Human Rights, and by the same expert on international law from the Central American University who facilitated the training workshop.

The purpose of the colloquium was to gather ideas and expert opinions on problems that arose in the international carriage of goods, in particular the carriage of goods by sea, identifying issues in transport law on which the Commission might wish to consider undertaking future work and, to the extent possible, suggesting possible solutions.

In May 2005, as part of its technical cooperation programme, the Division convened a regional training workshop for government officials on reporting on and implementation of the Convention and on the use of the Optional Protocol, as well as a judicial colloquium on the application of international human rights law at the domestic level.

At the regional level, there are also important instruments and declarations, such as the Convention Governing the Specific Aspects of Refugee Problems in Africa of the Organization of African Unity, the Cartagena Declaration on Refugees, adopted by the Colloquium on the International Protection of Refugees in Central America, Mexico and Panama, and the San José Declaration on Refugees and Displaced Persons.

On the occasion of that colloquium, a majority of speakers acknowledged that existing national laws and international conventions left significant gaps regarding issues such as the functioning of a bill of lading and a seaway bill, the relationship of those transport documents to the rights and obligations between the seller and the buyer of the goods and the legal position of the entities that provided financing to a party to a contract of carriage.

At its first session (New York, 20 24 May 2002), Working Group VI (Security Interests) had before it a first, preliminary draft legislative guide on secured transactions, prepared by the Secretariat (A CN.9 WG.VI WP.2 and Add.1 12), a report on an UNCITRAL CFA international colloquium, held in Vienna from 20 to 22 March 2002 (A CN.9 WG.VI WP.3), and comments by the European Bank for Reconstruction and Development (EBRD) (A CN.9 WG.VI WP.4).
