ESTABLISHMENT AND FUNCTIONS OF THE AD HOC CONCILIATION COMMISSION UNDER ARTICLES 12 AND 13 OF THE CONVENTION

According to the United Nations Conciliation Commission of Palestine, Palestinian refugees owned 5.5 million dunums of land.

The Commission has a broad range of powers, duties and functions, including mediation, conciliation, negotiation and investigation.

The conciliation proceedings are terminated

At its thirty fifth session (New York, 17 28 June 2002), the Commission adopted the UNCITRAL Model Law on International Commercial Conciliation.

For the purpose indicated in paragraph 1 of this rule, the Committee may, when appropriate, set up an ad hoc conciliation commission.

4. A conciliation is international if

Specialized training for the volunteers in mediation and conciliation would enhance the effectiveness of the Board and other conciliation mechanisms.

III. INTERNATIONAL COMMERCIAL ARBITRATION AND CONCILIATION 12

Where this does not succeed, the treaty body may establish an ad hoc Conciliation Commission consisting of five persons acceptable to the States parties concerned.

Fifty ninth report of the United Nations Conciliation

At that session, the Assembly established the United Nations Conciliation Commission for Palestine, composed of France, Turkey and the United States of America (resolution 194 (III)).

(a) An invitation by a party to engage in conciliation proceedings or the fact that a party was willing to participate in conciliation proceedings

Conciliation and arbitration should also be promoted through the establishment of conciliation and arbitration councils under the supervision of the local Chief of Justice.

(b) Where the parties wish to seek such an amicable settlement through conciliation, such conciliation shall take place in accordance with the UNCITRAL Conciliation Rules then obtaining, or according to such other procedure as may be agreed between the parties.

I solemnly declare that I will perform my duties and exercise my powers as a member of the ad hoc Conciliation Commission honourably, faithfully, impartially and conscientiously.

A AC.241 51 Procedures for conciliation and arbitration

1. When the conciliation proceedings commence, the running of the limitation period regarding the claim that is the subject matter of the conciliation is suspended.

Conciliation 81. UNCLOS also stipulates that parties to a dispute may agree, in accordance with its article 284, to submit their dispute to conciliation procedures.

This requires the Commission to monitor and analyse bills and policies of the Government, raise awareness, establish an effective conciliation process and undertake court actions for unresolved cases.

6. This Law also applies to a commercial conciliation when the parties agree that the conciliation is international or agree to the applicability of this Law.

2. Where the conciliation proceedings have terminated without a settlement agreement, the limitation period resumes running from the time the conciliation ended without a settlement agreement.

These, through institutionally established mechanisms in the case of the administrative authorities, or at the request of a party, deal with the appropriate judicial bodies the STPS the labour authorities in the states of the Federation the Federal Conciliation and Arbitration Boards the local conciliation and arbitration boards the Federal Conciliation and Arbitration Tribunal and the local conciliation and arbitration tribunals.

These, through institutionally established mechanisms in the case of the administrative authorities, or at the request of a party, deal with the appropriate judicial bodies, namely the STPS the labour authorities in the states of the Federation the Federal Conciliation and Arbitration Boards the local conciliation and arbitration boards the Federal Conciliation and Arbitration Tribunal and the local conciliation and arbitration tribunals.

2. Also notes with regret that the United Nations Conciliation Commission for Palestine has been unable to find a means of achieving progress in the implementation of paragraph 11 of General Assembly resolution 194 (III), and requests the Conciliation Commission to exert continued efforts towards the implementation of that paragraph and to report to the Assembly as appropriate, but no later than 1 September 2005
