Since its establishment in 2000, the Working Group on Sanctions had been reviewing the working methods of sanctions regimes, such as procedures for listing, de listing, and waivers, in an attempt to develop a set of recommendations to the Council.

The list of the UNSC sanction committee should be regularly reviewed and updated.

Some countries say that they are hesitating to submit names for listing because they allege the system lacks a robust de listing mechanism.

Recommendations were also made to improve the monitoring of the effects of sanctions and to ensure that fair and clear procedures exist for placing individuals and entities on sanctions lists and for removing them, as well as for granting humanitarian exemptions.

The proper implementation of the sanctions regime depends on Member States circulating the Consolidated List to all appropriate authorities.

It also emphasized that security sector reform should include the rehabilitation of the judicial, penal and immigration sectors and called for the adoption of clear, well defined and transparent criteria to guide individuals' inclusion in or exclusion from the sanctions list.

As an example of the evolution of targeted sanctions, lists of individuals and entities drawn up by sanctions committees play an increasingly important role in achieving the objectives of targeted sanctions.

Thirdly, on the subject of Security Council sanctions, the procedures for establishing and revising the lists of targeted individuals and entities must be improved.

Thirdly, when sanctions regimes adopted by the Security Council include lists of individuals or entities, the sanctions committees should establish precise procedures to allow for reviews to be conducted regarding those individuals or entities which claim to be placed or kept wrongly on such lists.

The Team recommends that the Committee remind States that this is entirely within the scope of the sanctions, which covers assets owned or controlled directly or indirectly by listed persons or on their behalf .

Listing especially of groups clearly has an important political and psychological impact.

Other cases have been filed or decided in several other countries that, while not challenging the sanctions, involve individuals or entities on the Consolidated List.

A better understanding of sanctions lists, and of their potential and limitations, is required at the level of sanctions committees and States.

Since Resolution 1373 does not establish a list of terrorists, the EU has developed its own system in order to list terrorist individuals, groups or entities not on the UN's 1267 list.

That would enhance the credibility of the sanctions regime, and it would increase the regime's effectiveness by providing additional safeguards so as to avoid keeping on the lists people who do not belong there.

The adoption of revised guidelines would assist the committees concerned in managing targeted sanctions lists in a uniform and transparent way.

That situation made it urgent to examine in depth all forms of unilateral sanctions which individual countries imposed on third countries outside the United Nations.

The Team regards the Consolidated List as the basis of the sanctions programme.

We also call upon the Security Council and the Secretary General to ensure that fair and transparent procedures, in accordance with international standards of due process, exist for placing individuals and entities on sanctions lists and for removing them, as well as for granting humanitarian exemptions.

Furthermore, these local courts would judge UN listings based on criminal standards of evidence, despite the fact that the List is not a criminal list.

Sixty five Member States have said that sanctions cannot be implemented against certain entries on the List without sufficient identifiers.

The inclusion of individuals and entities on sanctions lists should be carried out fairly and transparently, with due regard for their fundamental rights and freedoms, and there should be clearly defined procedures for listing and delisting them.

I urge Member States to continue to provide additional information regarding individuals already on the lists, as this will certainly improve the application of sanctions.

More States have come forward with names for the List, or improvements to existing entries, and to report activity with regard to implementation.

The Team's contacts with Member States suggest that commitment to the sanctions would be enhanced by greater relevance and accuracy in the List and a sense that the sanctions regime was dynamic in tracking the changing nature of the Al Qaida Taliban threat.

The Committee is aware of the importance of the circulation of the consolidated list and that the proper implementation of sanctions measures depends on Member States circulating the consolidated list to all appropriate authorities, intelligence agencies, designated non financial entities and professionals as relevant.

However, sanctions are not to be applied exclusively, but in addition to other measures.

Moreover, we cannot postpone the creation of a consolidated sanctions list of terrorists and terrorist organizations, regardless of whether or not they are associated with Al Qaida or the Taliban.

Many Member States have pointed out that a significant number of names on the List have insufficient identifiers to allow proper enforcement of the sanctions.

The key elements of the Security Council sanctions the Consolidated List, the assets freeze, the arms embargo and the travel ban continue to provide the basis for an effective regime.
