On 7 June 1983, the trial against the accused started in the Home Circuit Court, Kingston.

The Circuit Court returned the case to the District Court for reconsideration.

Below the superior courts there are the circuit courts, whose jurisdiction covers the political and administrative territorial unit known as a province.

Territorial organization article 66 of the Judicial Code establishes that the territory of the Republic has four judicial districts. These are divided into judicial circuits, which are subdivided into municipal circuits.

As a result of the decision of the Circuit Court, the case was remitted back to the first instance court. The author did not appear at this hearing, even though he was duly summoned.

On 6 July 1999, the Circuit Court affirmed the District Court's ruling.

France stated, by way of example, that there was no right to a review of verdicts of the Assize Court, or, in some cases, of the decisions rendered by the police court.

Similarly, during the hearing on 6 July 1999, the Circuit Court refused to allow the author to testify or to otherwise participate in the hearing.

C. The trial and the court judgement

2.12 On 11 March, the Trial Court dismissed the motion for reconsideration for lack of merit.

The Buga special circuit high court and the Pereira circuit criminal court cited bottlenecks in the judicial system, a heavy workload and the priority given to other decisions to excuse the failure to deliver a judgement.

The retrial took place in the Home Circuit Court of Kingston.

The addition of one Trial Chamber would allow the Tribunal to conduct trials simultaneously.

On 9 August 2002, the writ of habeas corpus was rejected by the Pereira circuit criminal court, which found that the court concerned had been unable to deliver a judgement because of bottlenecks or a heavy workload.

He was tried in the Home Circuit Court, Kingston, found guilty as charged and sentenced to death on 16 December 1987.

In a joint judgement, the full Family Court upheld the appeal and remitted the matter for rehearing.

3. The International Tribunal currently has 12 trials to be conducted by its two Trial Chambers.One trial is presently being conducted by a Trial Chamber of three judges who were permitted by the Security Council in its resolution 1126 (1997) to remain until November 1998 to complete the trial. (Prosecutor v. Zejnil Delalić, Zdravko Mucić, also known as quot Pavo quot , Hazim Delić and Esad Landžo, also known as quot Zenga quot , Case No. IT 96 21 T, T.Ch.II.)

In the instant case, the Committee notes that both the Circuit Court and Supreme Court considered the author's claims and it finds no evidence that these court decisions suffered from such defects.

On 30 January 2003, the fourth criminal court of the Bogotá special circuit dismissed the application for a review of the legality of Mr. Martínez Ramírez' detention.

However, it follows from the ICTR Statute that a Trial Chamber Section must be comprised of both permanent and ad litem judges.

2.1 On 28 September 1989, the author was convicted of the murder of Bertram Kelly and sentenced to death in the St. James Circuit Court, Montego Bay, Jamaica.

2.4 The author was subsequently accused of murder and tried in the Westmoreland Circuit Court on 21 and 22 February 1984.

Judges have been appointed in only 11 of 21 circuit courts, with the remaining vacancies expected to be filled before the start of the May court term.

The Tribunal is now running trials in the four courtrooms simultaneously.

The courts of justice comprise the Court of Final Appeal, the High Court (which consists of the Court of Appeal and the Court of First Instance), the District Court, the Magistrates' Court, the Lands Tribunal, the Labour Tribunal, the Small Claims Tribunal, the Obscene Articles Tribunal and the Coroner's Court.

The Trial Chamber denied this motion on 10 November 2005.

In two cases, the accused were brought before the courts.

5. In proceedings before courts and proceedings before assize courts, the accused juvenile must be given a defense counsel ex officio for the entire duration of the proceedings.

Training workshops for circuit court judges, magistrates and justices of the peace will be conducted following the appointments of judicial nominees.
