Procedure for the election of ad litem judges

Nine permanent judges are members of the three Trial Chambers, which is supplemented by ad litem judges.

Judge Van Den Wyngaert was elected as a permanent Judge of the Tribunal in the November 2004 elections while serving as an ad litem Judge.

The Chambers are composed of 16 permanent judges and a maximum of 9 ad litem judges.

The number of female Justices on the Supreme Court has risen to 41 (5 out of 12 permanent Supreme Court Justices).

The election of ad litem judges will take place in accordance with the following provisions

In Sweden, all future judges underwent quot in training quot as non permanent judges.

She began her duties as a permanent judge earlier than scheduled.

Hence, the full utilisation of ad litem judges depends on the availability of permanent judges.

However, it follows from the ICTR Statute that a Trial Chamber Section must be comprised of both permanent and ad litem judges.

On 19 November 2004, Judge Van Den Wyngaert had been elected a permanent judge of the International Tribunal with a term beginning on 17 November 2005.

The Tribunal is also grateful to the Security Council for resolution 1629 (2005), which permitted the early appointment of Judge Van Den Wyngaert as a permanent Judge of the Tribunal in October 2005.

A. Civil law countries As a general rule, in civil law countries judges are usually appointed after having completed special education for judges.

A member of the Court elected to replace a member whose term of office has not expired shall hold office for the remainder of his predecessor's term.

With the completion of most multi accused trials, more permanent judges will become available to sit with ad litem judges.

Another would be to allow the permanent judges to sit in more trials at the same time.

At present, several permanent judges are engaged in voluminous trials.

No retirement pension shall be payable to a former judge who has been elected a member of the International Court of Justice or who has been elected or appointed a permanent judge of the International Criminal Tribunal for Rwanda or who has been appointed to serve on the International Tribunal for the Former Yugoslavia or the International Criminal Tribunal for Rwanda as an ad litem judge until he or she ceases to hold that office or appointment.

Seven permanent judges are members of the Appeals Chamber, five of whom sit at any one time.

Acting as a judge

The Tribunal has greatly benefited from the possibility of re electing ad litem judges the election of a new pool of ad litem judges to be called upon for new trials the permission granted for nine ad litem judges to continue beyond the expiry of their terms and the early appointment of one ad litem judge as a permanent judge so that she could be assigned to a new trial.

Article 15 of the Statute of the Court provides that a member of the Court elected to replace a member whose term of office has not expired shall hold office for the remainder of the predecessor's term.

Judges often do not have that feeling, however.

Two permanent judges sit in the Butare trial and three in the Military I trial.

It had always been my desire to be on the bench, and as magistrate, I served at various judicial divisions of Kaduna State Judiciary, where I rose to the position of Chief Magistrate.

It also decided that three additional judges should be elected as soon as possible to serve in the additional Trial Chamber and that the judges so elected should serve until the date of expiry of the terms of office of the judges currently serving on the Tribunal (16 November 2001).

Additional prosecutors and judges have been appointed to staff those courts.

C. Conditions of recruitment of judges and procurators

(c) Our position on the issues is not solely that of the executive arm. Since the 1999 interpretation, several senior judges (including one Permanent Judge of the CFA and two judges of the High Court) have, at the time of their retirement, confirmed that there has not been any interference with judicial independence since the reunification. All agreed that the 1999 interpretation did not erode the rule of law and that there was no threat to judicial independence.

The result was the appointment (or reappointment) of 877 judges and prosecutors.

Consequently, the approval of the Security Council and the General Assembly is needed to allow Judge Van Den Wyngaert to serve as of 3 October 2005 on the Mrksic case given that she has been authorized to continue her functions only as an ad litem judge in the Limaj case and that she will begin her elected four year term as a permanent judge of the International Tribunal only on 17 November 2005.

Acting as a lay judge

Judge, Director of Studies at the National School for Judges and Court Officials (ENMG) and instructor in the juvenile affairs department, having been a juvenile judge for seven years in the court of first instance in Tamatave.

He is employed at the Supreme Court as a supreme court judge.

As such, Justice Hunt sat almost full time in the Court of Criminal Appeal, usually as the senior judge, and was responsible for the administration of the civil (common law) work and the criminal work of the Supreme Court.

Officer and director responsibilities and liabilities are generally imbedded in corporate and insolvency laws, which often interact with other national laws and policies.

Training workshops for circuit court judges, magistrates and justices of the peace will be conducted following the appointments of judicial nominees.

The pension benefit for the judges of the International Tribunal for the Former Yugoslavia and the International Criminal Tribunal for Rwanda, would be based on that applicable to the judges of the International Court of Justice, prorated to account for the difference in length in the terms of appointment, that is to say, nine years for the members of the International Court of Justice versus four years for the judges of both tribunals.
