(b) The differential minimum age of marriage of women and men

These ages are consequently the minimum allowed to have sex as a married couple.

267. The minimum age for admission to paid employment is 15 years.

It is also concerned that the minimum age of marriage for girls, fixed by law at 17, may be reduced by the religious courts, and that no minimum age is fixed for men.

Gabon had ratified the International Labour Organization (ILO) Minimum Age Convention No. 138, which set the minimum age for employment at 14, but its own legislation improved upon that by making 16 the minimum age.

Persons aged over 18 may freely contract marriage, but minors require the express permission of their father and mother and must be above the minimum age of marriage, which is 14 for males and 12 for females.

While noting that the State party has raised the minimum age of criminal responsibility in the Hong Kong SAR, the Committee remains concerned that the age of 10 years is too low.

In particular, the Committee is concerned at the absence of legislation regulating child labour providing for a minimum age for employment, the absence of a clear definition of the minimum age for criminal responsibility, the low minimum age for sexual consent, the lack of harmonization between the different ages of sexual consent among the four States, and the lack of legislation on neglect, abuse and sexual exploitation.

The Committee is also concerned at the low minimum age of access to employment, set at 12.

The same applies to marriages between persons who have not attained the age of majority or when marriage has been contracted by force or intimidation.

The State party is urged to raise the minimum age of criminal responsibility.

Ms. Gnacadja stressed the need to adopt legislation to raise the minimum age for marriage for both boys and girls and to ensure that that age was the same for either sex.
