In international law, there are several human rights instruments which provide that the individual should always have the right to an effective remedy in a domestic or international court in the event of violation of a right under one of those instruments.

This requirement implies that the right to assistance should be coupled with a right of appeal to an independent body and that the right of appeal should be an effective one, that is, that the right to assistance should be defined with sufficient precision so that it can be enforced through the judicial process.

The competent authority should give a ruling on the rights of the person seeking the remedy and ensure that the appropriate action is taken where the remedy is deemed justified, i.e. the right to reparation and to full and prompt implementation of decisions, inter alia.

Moreover, national law should empower affected individuals to assert these rights, for example, through mechanisms to claim compensation where public officials have failed to take reasonable measures to protect populations and prevent displacement due to disasters.
