Of particular concern in a number of countries are the conditions under which persons are kept in confinement while under sentence of death or under a moratorium.

13. With respect to the death penalty, persons aged less than 18 who committed a capital offence cannot be sentenced to the death penalty even if they are already 18 at the moment of the sentence.

OSCE has reported abolition of the death penalty for 3 crimes in Kyrgyzstan in 2004 for 10 crimes in Tajikistan and for 6 crimes in Uzbekistan leaving the death penalty available for only 2 crimes.

Countries that were already completely abolitionist were asked whether they had any policy to promote abolition in other countries whether there had been any attempts to reintroduce the death penalty whether they had adopted a policy relating to extradition of persons charged with capital offences and what alternatives to the death penalty had been established.

First, although the death penalty was prohibited by the Constitution of Puerto Rico, the United States Government had sought to impose it for a number of crimes committed in Puerto Rican territory.

All the responding retentionist countries stated that the law prohibited the execution of persons who had committed a capital offence when under the age of 18.

Mr. Lewis apos death sentence was commuted to life imprisonment on 30 March 1995, following the classification of his offence as non capital murder.

The remaining countries that are abolitionist for ordinary crimes can all be regarded as de facto abolitionist as far as crimes against the State or under the Military Code for which they retain the death penalty are concerned.

The death penalty is in place for a limited number of especially serious crimes, and every individual who is sentenced to death has the right to appeal the sentence and to petition for clemency.

4. Execution cannot take place until the condemned person apos s last remedy has been exhausted and until the death sentence has acquired final binding effect

Convicted drug traffickers received a mandatory death sentence.

Persons in the first category are liable to the death penalty (art. 14).

In Japan, 63 death sentences were imposed at initial trials on persons convicted of offences against the person.

The murder for which the author was convicted has been classified as a non capital murder consequently, the author apos s death sentence was commuted to life imprisonment in December 1992.

Thus, there is evidence to suggest that where the abolitionist movement has not persuaded retentionist countries to abandon capital punishment, it has had the effect of modifying the frequency with which they have recourse to execution.

As an interim measure, TRC also recommended a moratorium on and commutation of all death sentences.

It had before it a letter dated 8 March 2005 from the Permanent Representative of Jordan to the United Nations addressed to the Secretary General (E 2005 46).

Crimes against children such as sexual abuse, torture and forced labour, and offences resulting in death or disability, could entail capital punishment.

The trend in Mali over the past decade had been not to execute people who had been sentenced to death and, on 24 April 2004, a bill had been passed imposing a two year moratorium on executions.
