In many countries, judges were free to act in accordance with that provision, which was guaranteed in a number of countries.

The second paragraph of article 14 needed some work and could perhaps be regrouped with articles 24 and 29.

The representative of the Russian Federation stated that many articles of the draft were acceptable to his Government but that some needed modification.

Many States indicated that they could adopt paragraph 1 of article 14 and article 44 without change.

Under paragraph 2 of the same article, moreover, the licensing authority is required to obtain the consent of the Council of Ministers in order to grant a licence for the manufacture of explosives.

The Government can see a number of reasons to exercise caution in enacting new statutory provisions.

While draft article 18, paragraph 2, allowed States to exclude some types of contract, it did not allow them to refrain from applying certain provisions of the draft convention such as that pertaining to the notion of an original.

Permitting reservations to be made with respect to one provision, however, could encourage parties to make reservations with respect to other substantive provisions of the convention and thus weaken its efficacy.

A provision such as the above might be complemented by a provision that entrusts one organ with the authority to monitor the issuance of such licences, as in the following example

The simplest solution might be to allow each State to decide whether it would apply the relevant article.

The new law is more extensive and has many provisions similar to those embodied in the acts on public limited companies.

Meanwhile, the company signed the trademark license agreement with Heineken and authorized the China Resources Snow Breweries to use the relevant Heineken trademark to manufacture, market, distribute and sell the licensed products with a term of 20 years. Subsequently, it would be renewed according to the same terms and conditions, with each renewal of 10 years, until the termination terms of the trademark license agreement ended.

8. The working group noted that a new provision on the transfer of proceedings could be added to the text, perhaps in connection with an article on the principle aut dedere aut judicare.

Licences could be structured as exclusive or non exclusive and subject to limitations based on geography, field of use and or time requirements, as well as renegotiation of the licensing provision.

Paragraph (b) of that draft article could therefore be deleted.

The Joint Commission recommended that priority should be given to work on detailed terms and conditions under which licences will be issued in the Special Cooperation Area.

Just that one clause in the treaty.

There are also provisions in the law which permit the reduction of sentences for good conduct.

There was strong support for the suggestion that the draft instrument should indeed allow for exclusive jurisdiction clauses, particularly if the possibility for the abuse of such clauses was tempered by addition of certain conditions that would have to be fulfilled in order for such clauses to be valid.

The Study Group agreed, however, that such clauses might sometimes erode the coherence of the treaty.

The rules concerning persons permitted to form unions are very liberal.

Given the complexity of the issue, the draft article might even be split into several provisions.

D. Separability of particular articles

Article 7 (c) could read

However, the Government has not been enforcing the clauses of the license agreement, leading to lower taxes paid to the Government.

Should the draft instrument allow for exclusive jurisdiction clauses?

Consequently, parties should be allowed to derogate from most provisions.

The United Nations Office at Nairobi general conditions provides for a penalty clause which, if warranted, will allow the United Nations Office at Nairobi to claim liquidated damages.

Fifty four States had entered reservations to one or more articles in the Convention including permissible reservations to article 29 (1) and (2).

29. Many uncertainties exist concerning the application of these constitutional provisions.

The regulations make exceptions to the general rule for persons in possession of a licence issued under the Aboriginal Communal Fishing Licence Regulations, but the author states that he has been denied the benefit of this provision because of the Court's decision that his aboriginal rights had been extinguished by the Williams Treaty.

Consequently, the Christian object clause does not authorize preaching or indoctrination in Norwegian schools.

However, as the operations of these institutions are guided by their Articles of Agreement, which at the present time do not contain any explicit reference to human rights obligations, it may be more straightforward and useful to amend those articles to include such provisions.

c) items 5 and 6 (p. 12) Export control legislation and Licensing provisions The relevant penal provisions are contained in the 2001 Export Control of Dual Use Goods Act (amended in 2004) and in European Customs Rules Implementation Act from 2004.

These provisions can be applied only to natural persons.

Under article 15, paragraph 2, it is permissible to place restrictions on rights under article 14 these may be prescribed by law in relation to contempt of court.

The number of permits required for carriers for the implementation of this Agreement, as well as specific provisions related to terms and conditions for road traffic, shall be elaborated in annexes .

It is stated that the judge apos s refusal to allow the witness to be heard violates article 14, paragraphs 1 and 3 (e), of the Covenant.

The Commission might therefore further refine the provision on proportionality, at least in the commentary to the conclusive set of draft articles.

Once issued, the undertaking is available for payment in accordance with its terms and is irrevocable.

The Chairman invited the Commission to resume its discussion of draft paragraph 4 of draft article 9, which should perhaps be considered together with paragraph 5.

It was stated that another way of dealing with the matter was to allow the debtor to discharge its obligation by paying the assignor in case an assignment was made in violation of an anti assignment clause.
