A management review of the appeals process at Headquarters, Geneva, Vienna and Nairobi (A 59 408) determined that the timeliness of appeals could be improved by streamlining the process at most duty stations.

Under staff rule 111.2 (a), this review constitutes the first step of the appeals process.

This role is made clear to all parties from the initiation of the appeals process.

The portfolio process was in most cases led by national authorities, and in a number of countries was fully coordinated with the consolidated appeals process.

The vast majority of cases are expected to be tried by the Gacaca community court and appeals process.

The Unit also draws the attention of the office to the fact that, through this process, it can resolve potential cases before a formal appeals process is initiated.

Further efforts must also be made to improve the quality of, and therefore donor confidence in, the United Nations Consolidated Appeals Process.

Calls upon relevant United Nations organizations to continue to improve the transparency and reliability of humanitarian needs assessments and to engage in the improvement of the consolidated appeals process, inter alia, by further developing the process as an instrument for strategic planning and prioritization and by involving other relevant humanitarian organizations in the process, while reiterating that consolidated appeals are prepared in consultation with the affected State

The consolidated appeals process continued to be an important tool for coordination and strategic planning in complex emergencies and natural disasters in Africa.

As a result of continued inter agency efforts to improve the consolidated appeals process, needs assessments and strategic monitoring became more explicit and standardized.

(b) To advise both the appellant and the respondent as stated above, the Administrative Law Unit represents the respondent at all stages of the appeals process.

Currently, 27 appeals are pending (both ICTY and ICTR) comprising 13 appeals from Judgements, nine interlocutory appeals, two 11bis referral appeals, two review proceedings and one appeal from a decision of the ICTR President.

5. Strongly appeals to the international community to provide all necessary support for the smooth functioning of the electoral process in the Democratic Republic of the Congo

The 2005 Consolidated Appeals Process (CAP), coordinated through OCHA, requested from the international donor community US 300 million in March 2005, the shortfall was US 270 million.

He also welcomed the efforts undertaken by the United Nations country team to address the plight of internally displaced persons in its recently launched consolidate appeals process.

The Working Group on Speeding up Appeals, chaired by Judge Mumba and assisted by Judge Schomburg and myself, completed its work in July 2005 and circulated a final report with concrete proposals for improving the procedures, methods and working practices of the Appeals Chamber regarding interlocutory appeals, appeals from Judgements, appeals from guilty pleas and sentencing appeals.

Appeals against this decision were dismissed by the Appeals Chamber on 24 September 2003.

Second, the Working Group suggested means for accelerating appeals other than appeals from Judgements.

Appeals by more than 200 former employees, made redundant by the review process prescribed by the reform, were processed, while remaining members of staff were assigned to new positions.

This increase is further compounded by the fact that the Appeals Chambers considers ICTY appeals as well.

The consolidated appeals process 2005 for West Africa underlined the need to fund a regional humanitarian response strategy with project proposals that provide a broad range of cross border support services.

As the Appeals Chamber's workload increases, consideration is still being given to increasing the capacity of the Appeals Chamber by having two Benches of five Judges available for the disposition of appeals.

In 2005, the consolidated appeals process focused primarily on trying to alleviate the deterioration of human security in West Africa, hence the ongoing close collaboration among the humanitarian, political and military actors.

All of their appeals concerning the issuance of visas are pending before the United States Eleventh Circuit Court of Appeals.
