Gender Equality Act

Ireland's far reaching equality legislation included the Employment Equality Act 1998 and the Equal Status Act 2000.

In addition to the Employment Equality Act and the Equal Status Act he had just mentioned, equality was promoted by an Equality Authority.

Based on the Gender Equality Act the Gender Equality Council will be established.

The Gender Equality Act stipulates an obligation of employers actively to promote gender equality.

The Government of the Republic of Namibia enacted the Married Persons Equality Act in 1996. The Married Persons Equality Act has significantly advanced sexual equality between spouses in civil marriages.

To this end, the Married Persons Equality Act (Act 1 of 1998) was promulgated.

The Gender Equality Act provides for the creation of a new institution the Gender Equality Commissioner.

Two new institutions will be created according to the Act Gender Equality Commissioner and Gender Equality Council.

On 1 May 2004 the Gender Equality Act entered into force.

With regard to other legislation, the Labour Act (Act 6 of 1992), has outlawed discrimination on the basis of sex in most aspects of employment, the Income Tax Act (Act 4 of 1981) has done away with sex discrimination by a series of amendments to the Act, and the Government of Namibia enacted the Married Persons Equality Act (Act 1 of 1996).

According to the Gender Equality Act an injured party may demand compensation for damage and termination of the harmful activity.

The right to equal conditions and selection criteria in employing men and women is established in the Gender Equality Act.

The revised version of the Gender Equality Act of Norway (2002) enhanced the responsibility for gender mainstreaming in public policies.

In Finland, the Act on Equality states that the promotion of gender equality is the task of all Government ministries and that gender mainstreaming must be carried out in the entire State administration.

In such cases the court may award compensation based not only on the Gender Equality Act but also on other acts.

The General Education Act, which established equal access, gender equality and non discrimination in education, had been a major step forward for formal education in Paraguay.

According to the Gender Equality Act an official of the structural unit of the Ministry of Social Affairs which deals with gender equality provides consultation to all persons on matters related to implementation of the principle of equal treatment for men and women.

The Court then considered whether the rule became unconstitutional and unlawful when the Constitution came into force on 21 March 1990, or only when the Married Persons Equality Act (Act 1 of 1996) came into force on 15 July 1996.

Turning to the Conference's impact on Estonia, she said that the most important step had been the adoption in 2004 of the Gender Equality Act, which explicitly prohibited direct and indirect discrimination and obliged authorities and employers to promote gender equality, thus strengthening the legal basis for promoting de jure and de facto gender equality in the country.

Yet equality before the law was not the same as equality in rights or gender equality.
