Right to form trade unions the right of trade unions to function freely Article 108 of the Satversme prescribes that the state protects the freedom to form trade unions.

By defining unfair practices, article 53 offers one means of protecting trade union activity.

Under Article 4 of the Law On Trade Unions trade unions have the right to join international trade union organisations, to enter into agreements and treaties with these international organisations, as well as foreign trade unions.

136. In the exercise of trade union freedom, workers are entitled to establish any of the types of trade union indicated in article 10 of Act No. 23.551.

Article 12 of the Constitution regulates the free activities of citizens apos associations, such as trade unions.

118. Other matters queried in terms of article 5 were the treatment of workers, notably women in free trade zones, trade union freedoms and equal employment opportunities.

Article 10 of General People's Committee for Economy and Trade Decree No. 2 of 1981 provides as follows

As the general rule is included in article 3(1), but subject to article 4, there is a possibility of specifying the position of volume contracts intended for liner trade in article 4(1).

Article 372 of the Act stipulates that foreign nationals may not form part of the executive boards of trade unions.

The modalities of application of Article IV of the General Agreement on Trade in Services had also to be examined.

It was suggested that some tramp trade might fall under the definition in draft article 3 (1)(d) of the draft instrument, and that, in order to protect third parties holding documents issued in this trade, reference to draft article 3 (1)(d) should be added at the end of the proposed draft of article 4.

163. Article 254 of the Labour Code grants any member of a trade union the right to leave it at any time.

It prohibits, in article 5, quot all forms of exploitation and degradation quot , including in particular slavery and the slave trade.

87. The freedom and independence of trade unions is also proclaimed in article 33, paragraph 1, of the Labour Code, as quoted above.

Article 6 on the right to work, article 7 on just and favourable conditions of work, article 8 on the right to form and join trade unions, article 9 on the right to social security and, in particular, article 11 on the right to an adequate standard of living, can be directly related to income distribution.

This right is protected by the provisions of article 47 of the Act, which protects all workers or trade union associations prevented or hindered from normally exercising the right to take part in trade union activity.

Article 11 of the Law provides relations between employers' organisations and their associations and trade unions taking into account the above classification.

Article 4 of Act No. 83 112 of 12 December 1983, referred to above, provides that quot public employees shall have trade union rights.

As stated under Article 11, there is no bar on women in seeking any employment or starting any trade.

Recent trends in trade, transport and logistics have led to new requirements in the area of trade facilitation, which have also been analysed in an article in the Transport Newsletter (UNCTAD WEB SDTE TLB 2005 2).

126. The first section of the Act which relates to the protection of trade union freedom, embodies the constitutional principle of free and democratic trade union organization subject to no other formality than registration in a special register (article 14 bis).

86. As stated above, the freedom to form trade union organizations and alliances is explicitly proclaimed in article 49, paragraph 1, of the Constitution.

Article 36 gives citizens the right to form and be members of trade unions and requires gender neutrality through equal pay for equal work .

At the United Kingdom's request, members of the European Community, Australia, New Zealand and Canada adopted trade sanctions including a temporary prohibition on all imports of Argentine products, which ran contrary to article XI 1 and possibly article III of GATT.
