The Zambian economy is heavily dependent on copper and cobalt mining.

B. Prospecting and exploration for polymetallic sulphides and cobalt rich ferromanganese crusts deposits in the Area

(g) prospecting means the search for deposits of polymetallic sulphides or cobalt crusts in the Area, including estimation of the composition, sizes and distributions of deposits of polymetallic sulphides or cobalt crusts and their economic values, without any exclusive rights

34. While the work continues on the mining code covering polymetallic nodules, the two other types of minerals found in the Area are gaining in importance polymetallic sulphides with economically attractive metal contents of gold, silver, copper and zinc, and cobalt bearing crusts having a similar metal composition as polymetallic nodules but with a much higher cobalt content.

15. Notes the preliminary discussion of issues relating to the regulations for prospecting and exploration for polymetallic sulphides and cobalt rich crusts in the Area

The immediate priority for the Authority is the development of a regulatory regime for prospecting and exploration of polymetallic sulphides and cobalt rich ferromanganese crusts.

The Dutch plaintiff was the assignee of a Dutch company, which had sold four different quantities of cobalt sulphate to the defendant, a German company.

The International Seabed Authority is currently involved in the development of a legal regime for the prospecting and exploration of polymetallic sulphides and cobalt rich crusts.

13. Notes the progress of the discussion of issues relating to the regulations for prospecting and exploration for polymetallic sulphides and cobalt rich crusts in the Area

The contractor shall have the exclusive right to explore an area covered by a plan of work for exploration in respect of polymetallic sulphides or cobalt crusts.

(i) A description of the technology related to the recovery and processing of polymetallic sulphides or cobalt crusts that is necessary for making the designation of a reserved area

2.2 The Contractor shall have the exclusive right to explore for (polymetallic sulphides) (cobalt crusts) in the exploration area in accordance with the terms and conditions of this contract.

The Authority reserves the right to enter into contracts with respect to resources other than (polymetallic sulphides) (cobalt crusts) with third parties in the area covered by this contract.

Notwithstanding further delays, the mine is due to open in 2007 and is expected to eventually produce 60,000 tonnes of nickel and 5,000 tonnes of cobalt per year.30

10.4 The Contractor shall keep, in good condition, a representative portion of samples and cores of the (polymetallic sulphides) (cobalt crusts) obtained in the course of exploration until the expiration of this contract.

The Authority shall ensure that no other entity operates in the same area for resources other than polymetallic sulphides or cobalt crusts in a manner that might interfere with the operations of the contractor.

Prospectors shall cooperate with the Authority in the establishment and implementation of programmes for monitoring and evaluating the potential impacts of the exploration and exploitation of polymetallic sulphides and cobalt crusts on the marine environment.

At its 93rd meeting, on 2 June 2004, the Council took up the draft regulations on prospecting and exploration for polymetallic sulphides and cobalt rich ferromanganese crusts contained in document ISBA 10 C WP.1.

The draft text deals with the prospecting and exploration for polymetallic nodules, one of three types of minerals to be found in the Area, having economically attractive metal contents of copper, nickel, cobalt and manganese.
