In general his delegation agreed with the use of the criterion of habitual residence for the attribution of nationality in connection with the succession of States, provided that habitual residence constituted an effective legal connection between the State and the person concerned.

Article 5, paragraph 2 adds that the authorities of the State of the new habitual residence are competent.

27. With regard to the prevention of statelessness, the Special Rapporteur s proposal in his third report to combine the criteria of habitual residence and the principle of continuity of secondary nationality was more in keeping with contemporary practice and realities than the Commission s reliance on habitual residence alone.

It provided that the successor State should attribute its nationality to persons who had their habitual residence in the transferred territory.

The concept of habitual residence was a positive feature of the draft and the Commission was to be congratulated on maintaining a balanced approach by treating the presumption of nationality in respect of habitual residence as arising only in the absence of any other prevailing provision or subject to agreement between States.

10.1 All refugees and displaced persons have the right to return voluntarily to their former homes, lands or places of habitual residence, in safety and dignity.

10.2 States shall allow refugees and displaced persons who wish to return voluntarily to their former homes, lands or places of habitual residence to do so.

It was unclear why the citizenship of such a unit, recognized under the federal constitution, should be disregarded, and habitual residence treated as the only relevant criterion.

10.3 Refugees and displaced persons shall not be forced, or otherwise coerced, either directly or indirectly, to return to their former homes, lands or places of habitual residence.

43. The draft articles also contained a special provision on presumption regarding the acquisition of the nationality of the successor State by persons maintaining habitual residence in that State.

Although habitual residence was less used in practice, it appeared to be more specific than citizenship, and was in line with the trend to enhance effectiveness in international law.

Unexpected versus habitual.

10. He agreed with the decision to adopt as the main criterion for identifying subjects to whom successor States must grant nationality the criterion of habitual residence rather than citizenship.

136. Article 5 of this Convention gives examples of cases in which the habitual residence of an infant is transferred in such a way that it does not affect his protection.
