C7 Real Property claims seek compensation for losses related to real property, including costs incurred for repairs and other losses.

For example, in UNCC claim No. 3012210 the claimant, who was 22 years old at the time of the invasion, asserted tangible property and profit losses totalling USD 5.6 million for his auto repair shop in Kuwait.

Real property None of the claims in this instalment seek compensation for a loss of real property.

Accordingly, the WBC Claim as amended amounts to US 950,715,662.

Subsequent to the oral proceedings the Claimant amended the WBC Claim, which resulted in a reduction of the amount claimed by US 915,209.

Claims Review Property Survey Board

There is one claim in this instalment where the claimant established that she owned real property in Iraq however, her claim for C7 Real Property losses fails as she did not establish the fact of loss.

With regard to the compensability and the verification and valuation of these tangible property claims, the Panel has applied the approach set out in paragraphs 108 to 135 of the First E4 Report, but, where necessary, has modified this approach to take into consideration the particular circumstances of the stand alone claimants.

The Commission for Real Property Claims, established under annex 7 to the Agreement, adjudicates claims for real property where the property has not voluntarily been sold or otherwise transferred since 1 April 1992, and where the claimant does not presently enjoy possession of that property.

First claim unit Medical treatment and public health facilities for refugees Iran seeks compensation in the amount of USD 5,639,273 for losses suffered as a result of the influx of refugees into its territory between 2 August 1990 and 2 March 1991.

The Panel finds that, with respect to the claim for the loss of tangible business property, all of the re allocated elements except for business general assets in the amount of USD 12,051,323 are inconsistent with the claim as described by the claimant in his personal statement and are in fact new claims that are time barred.

The Panel recommends no awards of compensation in respect of the four claims for C7 Real Property in the fourth instalment.

The Panel reviewed each proposed amendment to ensure that it did not constitute a new claim filed after the appropriate deadlines.

The Panel agrees that the company's claim did not include a claim for the partnership assets, and determines that these claims do not overlap or duplicate each other.

In the first set of competing claims, a Palestinian claimant and a Kuwaiti claimant filed separate claims in categories D and C respectively for the losses of the same car repair business in Kuwait.
