As a result, approximately 5,000 duplicate claims were identified and eliminated during the course of claims processing.

Accordingly, the WBC Claim as amended amounts to US 950,715,662.

In its Third Report, the Panel outlined the modifications that it applies to the methodologies established by the category C Panel in the substantive processing of C3 Death losses.

As a result of these matching procedures, the Panel determined that a total of 4,4,82 claims or nine per cent of the total claims population were not eligible for inclusion in the late claims programme.

During the course of its review of claims in the special instalment, the Panel identified one claim that included D8 D9 (individual business) losses in respect of two ready made clothing businesses that were also the subject of a category D claim filed by an Indian claimant in the regular claims programme, which was awarded compensation.

This global approach was suited to the specifics of category C claims processing, as category C claims are subject to mass claims processing procedures and are not subject to extensive individual review or claim development.

The WBC Claim as amended by the Claimant can be analyzed as follows

During the review of the stand alone claims in this instalment, one instance of a related category C claim was identified where a category D claimant had already received an award for the company's losses.

During the course of the Panel's eligibility assessment of claims, a total of 10,10,35 claims were scrutinized for potentially irregular documents submitted by claimants.

In its First Report, the Panel outlined the modifications that it applies to the methodologies established by the category C Panel in the substantive processing of C2 MPA losses.

22. Further, the Panel recommends approval of corrected recommended amounts for three claims from the second instalment.In December 1996, the Governing Council accepted the Panel s recommendation that pursuant to Decision 24, in the case of 42 confirmed matches of category A claims and category C1 quot departure claims from the second instalment, appropriate deductions be made from the compensation awarded to the category C claimants.

ISSUES ARISING IN THE PANEL'S REVIEW OF BEDOUN CLAIMS Introduction

The Claimant asserts that during the evacuation several of its cars were left in Baghdad.

Two other large claims were in arbitration at the time of the audit.

The Panel s classification of the Kuwaiti Claims as well as the remaining nine Claims was stated in the Procedural Orders that were transmitted by the secretariat to each Claimant.

The Panel is of the view that in a late claims programme, there is a risk that third parties not eligible for late filing may attempt to claim their own losses through claimants in this instalment.

Pursuant to Procedural Order No. 1, the secretariat transmitted to Iraq copies of the claim files, comprising the claim form, statement of claim and related exhibits, for each of the claims in the fifth F4 instalment except for those claims which had already been transmitted in a previous instalment as described in paragraph 5 above.

For example, in UNCC claim No. 3012210 the claimant, who was 22 years old at the time of the invasion, asserted tangible property and profit losses totalling USD 5.6 million for his auto repair shop in Kuwait.

In the claim under review, where the claimant was not located in the compensable area and did not have a presence in the compensable area, the Panel finds that the claimant has not provided sufficient evidence to demonstrate a previous business practice or course of dealing with parties located within the compensable area and, therefore, no compensation is recommended.

13.8 Where restitution claims forms cannot be sufficiently simplified owing to the complexities inherent in the claims process, States should engage qualified persons to interview potential claimants in confidence, and in a manner that is age and gender sensitive, in order to solicit the necessary information and complete the restitution claims forms on their behalf.

The Panel reviewed each proposed amendment to ensure that it did not constitute a new claim filed after the appropriate deadlines.

During the course of its review of the responses submitted by the category D claimants pursuant to article 34 of the Provisional Rules For Claims Procedure (the Rules ), the D2 Panel became aware of the existence of a group of category D claimants who asserted corporate losses in their capacity as shareholders in Kuwaiti companies.

In the first set of competing claims, a Palestinian claimant and a Kuwaiti claimant filed separate claims in categories D and C respectively for the losses of the same car repair business in Kuwait.

The amount claimed column shows the compensation sought by the Claimants (with amendments, where applicable) expressed in United States dollars (USD) and corrected, where necessary, for computational errors.

As the role of the claim preparers in the preparation of claims appeared to warrant further scrutiny, at the Panel's instruction, a number of claim preparers were interviewed during the technical mission to Jordan in January 2005.

Iran, therefore, could have included these claim units in the submissions that it filed within these deadlines.
