III. Relationship between the International Atomic Energy Agency and the Committee

The cooperation between IAEA and the Committee continued to grow in the mid 1970s, with the transfer of the Committee to Vienna being noted in the IAEA annual report for 1974 75.j Since the early 1980s, the work of the Committee has been reported on in the IAEA annual Nuclear Safety Reviews, which are submitted to the IAEA Board of Governors and published by IAEA.

The Chairman of the IAEA Board of Governors summarized the Board position at the time by saying that cooperation between IAEA and the Committee should be intensified.i

Although Greenpeace does not have status with IAEA, it has nevertheless been able to participate as an observer in the IAEA Standing Committee on Nuclear Liability.

In other words, the work of the new Committee should not duplicate that of the Agency.

On the other hand, the view was expressed that IAEA had its specific mandate, that it was within the Ad Hoc Committee s mandate to undertake the drafting of the convention and that IAEA could be invited to provide expert advice to the Committee.

2. In accordance with paragraph 9 of resolution 51 210, the Ad Hoc Committee was open to all States Members of the United Nations or members of the specialized agencies or of the International Atomic Energy Agency (IAEA).1

14. Cooperation between the Committee and IAEA grew even further in the 1980s.

26. In line with the IAEA recommendation, the Committee recommends that the General Assembly maintain the present functions and role of the Committee, including the present reporting arrangements.

However, the functions and role of IAEA in this area differ somewhat from those of the Committee.

European and international supervision of nuclear material is made by the EU Commission and the IAEA (Euratom Treaty, INFCIRC 193).

I. Functions and role of the United Nations Scientific Committee on the Effects of Atomic Radiation

PRINCIPLE 11. ADVISORY FUNCTIONS OF THE COMMISSIONS

59. On 17 and 18 June the Advisory Committees met with the representatives of UNIDO and IAEA.

IAEA is of the view that the Committee has fulfilled in an exemplary manner the functions and role assigned to it by the General Assembly in resolution 913 (X) of 3 December 1955 and that the Committee s functions and role, which are of major importance to IAEA, continue to be appropriate.

In paragraph 38 of the annex to Assembly resolution 51 241, it is recommended that the Assembly invite IAEA and WHO to consider the Committee s functions and role and to submit a recommendation to it in 1998 and that the Committee should be asked to submit its next report to IAEA and WHO as well as to the Assembly, which would discuss the report along with any evaluation of it by IAEA and WHO.

An evaluation of the report of the United Nations Scientific Committee on the Effects of Atomic Radiation, also requested in the resolution, will be submitted when the report is received by the Agency for comments.

g Upon Committee on the Peaceful Uses of Outer Space approval, the Chairman of the Committee sends a letter to the Director General of the International Atomic Energy Agency requesting a technical review of multilaterally developed guidelines by the Agency.

34. The Committee decided to recommend to the General Assembly that the paragraphs of the report of the International Atomic Energy Agency (IAEA) dealing with the subject matter of item 71 should be drawn to the attention of the First Committee in connection with its consideration of the item.

10. Requests the Secretary General to invite the International Atomic Energy Agency to assist the Ad Hoc Committee in its deliberations

IAEA therefore recommends that the General Assembly maintain the present functions and role of the Committee, including the present reporting arrangements.

All of the nuclear material in Brazil is accounted for by the National Commission for Nuclear Energy (CNEN) and is subject to IAEA Comprehensive Safeguards.

11. In the early years of the two organizations, however, the cooperation between the Committee and IAEA was from time to time a matter of concern for some IAEA member States.

Members of the Board representing the International Atomic Energy Agency (IAEA) and the World Intellectual Property Organization (WIPO) Staff Pension Committees noted the increases in the total number of active participants in their respective organizations since the establishment of the 33 member Board.

Both WHO and IAEA send observers to attend the Committee sessions, and there is close collaboration with them in the development of Committee reports.

IAEA stated that it was ready to fulfil its role as depositary should that be the will of the Ad Hoc Committee.

The General Committee decided to recommend to the General Assembly that the relevant paragraphs of the annual report of the International Atomic Energy Agency should be drawn to the attention of the First Committee in connection with its consideration of item 99.

The Subcommittee noted the statement made by the representative of IAEA stating that the Principles should be reviewed in view of the most recent International Commission on Radiological Protection (ICRP) recommendations on radiation safety incorporated into the IAEA International Basic Standards for Protection against Ionizing Radiation and for the Safety of Radiation Sources, published by IAEA as Safety Series No. 115.

As a member of the IAEA Board of Governors, Singapore will continue to lend its full support to the Agency and its work.

19. The IAEA secretariat felt that it was important to preserve the Committee s full independence and, in February 1992, in the IAEA Board of Governors, the Director General said that the initiative regarding a possible merger had not come from the Agency, which had not, in fact, been consulted.
