Other remedies available to the victim include access to administrative and other bodies, as well as mechanisms, modalities and proceedings conducted in accordance with domestic law.

(b) Take measures to minimize the inconvenience to victims and their representatives, protect against unlawful interference with their privacy as appropriate and ensure their safety from intimidation and retaliation, as well as that of their families and witnesses, before, during and after judicial, administrative, or other proceedings that affect the interests of victims

A court may choose not to grant a remedy to an applicant who is otherwise entitled.

3. Possible remedies

Other remedies available to the victim include access to administrative and other bodies, as well as mechanisms, modalities and proceedings conducted in accordance with domestic law.

And we can do all sorts of things to fix it, but in the final analysis, the thing we really need to fix is ourselves.

A further proposal was to restrict the relief to that available to the insolvency administrator in the enacting State.

It does not provide enforceable remedies .

Paragraph (1) had already taken into account the possibility of an urgent need for provisional relief by authorizing the granting of provisional relief prior to final recognition.

III. VICTIMS PROTECTED AND REMEDIES AVAILABLE TO THEM

6.3 The Committee recalls that mere doubts about the effectiveness of remedies do not absolve an individual from exhausting them.

The Committee considers that the insurmountable procedural impediment faced by the complainant as a result of the inaction of the competent authorities rendered the application of a remedy that may bring effective relief to the complainant highly unlikely.

The victim could also seek civil redress.

However, it is the Committee's constant jurisprudence that the rule of exhaustion applies only to the extent that those remedies are effective and available.

The State party adds that the Williams case, which is available on the Internet, clearly establishes the existence of a domestic remedy, and that the author cannot be excused for not having exhausted that remedy.

It would be possible to do an analysis of the case law of human rights bodies on the content of the right to a remedy.

Therefore, it was considered that the moment of recognition was not a suitable reference for terminating relief.

Finally, even if that recourse had failed, it would have been open to the author to appeal to Federal court instances.

The Government also indicated that Saadi Bouslimani had not exhausted all domestic remedies available to him and that some of these remedies were still available.
