Justice sector reform

Reform of the justice sector continues at a slow pace.

The Division offered comments and advice on the draft legislation for the reform of the judiciary.

34. While it may be relatively easy to change a dubious system in other sectors, this is not the case of the justice sector.

A reform of the judicial sector was also under way, as part of the Government's programme to consolidate the rule of law.

75. On the whole, the reform of the justice sector is moving slowly, partly because of the constraints imposed by the existing constitutional framework and the uncertainty surrounding the constitutional reform process, and partly because of institutional resistance to change.

The international community should continue giving support for reform and the strengthening of the judicial sector, including reform of the Supreme Court and the Office of the Attorney General, merit based recruitment and training of judicial officers, and rehabilitation of the infrastructure.

Anti corruption, legal and judicial reforms, public administration reforms and armed forces reforms have been undertaken by the Government of Cambodia.

Reform in the justice sector has progressed more slowly than hoped for, impacting on the fair and effective administration of justice.

Reforms in the judicial sector had had a limited impact or had been delayed, contributing to impunity.

They expressed great hopes that these and other problems might be alleviated with the reform which is to be introduced with the new Code of Criminal Procedure, to which certain sectors of the judiciary are however opposed.

UNMIL has sustained its monitoring and advisory activities in the justice sector and is helping to implement reforms to strengthen the capacity of the courts and the prosecution.

We have overhauled our legal system, and we are adopting high standards of good governance in the corporate and public sector.

For all its imperfections, this reform continues to be, together with the modernization of the entire justice sector, a central component of the peace process.
