According to the Trade Unions Act, persons have the right to form trade unions freely, without prior authorisation, and to join or not to join trade unions.

The Committee is concerned that the Labour Code in the State party limits, to a required minimum of 30 workers, the right to set up a trade union section or a staff association designed to create a labour union section.

Under this type of contract, workers may not be hired to replace workers who have stopped working because of labour union activities.

Separate conceptualization of the term public employee as distinct from the term worker has always been without practical implications for the trade unionism of State workers, as the structuring of trade unions for State workers took place alongside that of other associations and their right to form trade unions has never been called into question.
