Lawyers report that they experience serious difficulties in gaining access to their clients.

Local lawyers have informed the Belgrade office of the High Commissioner Centre for Human Rights that several persons arrested during the recent demonstrations were not informed of their right to consult a lawyer and were denied counsel during their trials.

According to the JFBA, The Japanese Criminal Justice System doesn't adequately provide the right to counsel and the right to defence and fails to meet international human rights standards .

In fact, lawyers are specifically permitted by the Code of Criminal Procedure to be present when their client is examined by the investigating judge (art. 67).

The Centre for Human Rights notified the solicitors for the claimants, by letter dated 22 December 1995, of the Special Rapporteur apos s immunity from legal process under the Convention on Privileges and Immunities of the United Nations (1946).

The author states that the judgement characterized him in public as a swindler, a lawyer who had received payment in advance and had done nothing to defend his client.

The fact that these persons have been prevented from consulting lawyers and that the subsequent proceedings were also held without the presence of lawyers constitute very serious breaches of the right to due process and the right to a fair trial recognized in the Universal Declaration of Human Rights.

Furthermore, the authors failed to indicate how their attorneys would have acted against their instructions, and there was no indication that Mr. Morrison apos s attorney or junior counsel representing Mr. Graham had acted negligently in the discharge of their professional duties.

(e) The Government should review legal provisions which permit broad restrictions to be imposed on free communication between lawyers and their clients (art. 74 (2) of the Code of Criminal Procedure), and ensure that they comply with international human rights standards which stipulate that all communication between lawyers and their clients should normally be conducted in private in full confidentiality, at most within sight but not within the hearing of any officials.

143. The Special Rapporteur believes that the incidence of police abuse could be substantially reduced if lawyers were granted prompt access to all arrested persons and if laws requiring that arrested persons be informed of their right to consult a lawyer were properly enforced.
