The powers enjoyed by the municipalities in the areas of urban planning, local development, electricity supply concessions and local taxation may be expanded.

There are many problems with such systems of trust title.

200. It was considered that legislation should not establish a maximum number of years for which concessions might be granted.

Of equally critical importance was the decision on a one time equity allocation of special drawing rights which would henceforth allow all members to participate in the special drawing right system on an equal footing.

Here, too, it might be desirable to limit the withdrawal of the concession during its operation to particularly serious circumstances.

A similar restriction should exist as regards the right of the host Government to approve the granting of a subconcession by the concessionaire (para. 37).

As such, they were subject to a special legal regime that differed in many respects from the regime that applied generally to the award of public contracts for the purchase of goods, construction or services.

The states also administer significant elements of the Australian legal system. They exercise responsibility in many matters of relevance to the implementation of human rights.

It was observed that the text of the legislative recommendation and the corresponding notes did not distinguish adequately between obligations imposed on an operator pursuant to the applicable regulatory regime and contractual rights or obligations that might be provided in a bilateral concession agreement.

The human rights regime

These are precisely the situations which, usually upon the demise of the authoritarian regime that institutionalized them, require the adoption of special measures by the democratic system which has replaced it.

The mere existence of a regime of privileges and immunities will not prevent institution of legal proceedings.

7. The use of sanctions for the purpose of overthrowing or changing the lawful regime or existing political order in the country which is the object of sanctions is not permissible.

Where multiple concessions are awarded for the same sector, the host Government may expect that the competition among the concessionaires will have a certain regulatory effect and will be conducive to achieving efficiency and quality targets.
