At its twenty fourth session, the Working Group commenced its work by considering a number of preliminary draft uniform rules contained in a report by the Secretary General entitled quot Discussion and preliminary draft of uniform rules quot (A CN.9 412).

The Working Group had been requested to provide the Commission with sufficient elements for an informed decision to be made as to the scope of the uniform rules to be prepared.

Arguments in favour of a priority rule based on the time of assignment included that such a rule was simple, practical and conforming with legal tradition in a number of countries.

It was suggested that, should the Working Group wish to circumscribe the scope of the draft uniform rules to the latter purpose, an opening paragraph might need to be inserted in draft article B along the following lines These uniform provisions apply to certificates issued pursuant to a legal regime having the following attributes .

Some of these prohibitions cover steps which have the result of denying uniform opportunities for supply (discrimination), while others cover aggressive selling techniques or the imposition of uniform minimum prices.

The same report further suggests that harmonized rules that rely for their enforcement on unilateral actions taken by the harmed jurisdiction would be disadvantageous for small economies and would not meet their concerns with regard to extra territorial conduct with negative effects on their domestic markets, so such harmonized rules should include a rule that prevents all export cartels.

After discussion, the Working Group agreed that, in principle, the draft uniform rules should contain provisions regarding the liability incurred by certification authorities in the context of their participation in digital signature schemes.

The question as to whether the natural person did in fact and in law have the authority to act on behalf of the legal person would thus be left to the appropriate legal rules outside the uniform rules.

Accordingly, it was suggested that no minimum requirements should be established by the draft uniform rules as to the contents of a certificate.

Pending a final decision as to the form of the uniform rules, the suggestion to prepare a convention at a later stage should not distract the Working Group from its current task, which was to focus on the preparation of draft uniform rules on digital and other electronic signatures, and from its current working assumption that the uniform rules would be in the form of draft legislative provisions.

It might refer, in a positive sense, to a rule or principle with a regional sphere of validity in relation to a universal rule or principle or, in a negative sense, to a rule or principle that imposed a limitation on the validity of a universal rule or principle.
