2. The rules of the law of either the forum State or any other State that are mandatory irrespective of the law otherwise applicable may not prevent the application of a provision of the law of the State in which the assignor is located.

In the latter case, a different approach is taken by those laws that provide for the subsidiary application of administrative law only, or that establish a hierarchy of legal provisions applying to the project.

Such a provision would enhance legal certainty regarding the scope of application of the draft convention.
