Under the Europe agreements between the European Union and those Central and Eastern European countries which are not yet EU members, competition standards based upon European Union competition rules are applicable where trade between the European Union and the other signatory is affected.

Under the Agreement of the European Economic Area (EEA), concluded by the European Union with most countries of the European Free Trade Area (EFTA), all practices liable to impinge on trade and competition among the EEA participants are subject to rules that are virtually identical to European Union competition law.

How to combine the necessary confidentiality of commercial transactions (including through encryption of messages) with existing rules on export control or competition?

All of these three regional arrangements have a supranational character, as in the case of the EU (which provides for common regional competition rules to be enforced by both the EU Commission and national competition authorities).

Developing countries would benefit from the contribution which a convergence of national competition rules would make to the global economy, and from the rights to immediate application of international competition rules, access to dispute settlement machinery and technical assistance, while they themselves would be subject to obligations only after a transitionary period.

Likewise, European states accept the common norms and rules of the Organization for Security and Cooperation in Europe, and are almost always prepared to be regulated by them. Indeed, the European Union is the fruit of a long, continuous effort to strengthen common norms and rules among European states.
