Acquiring a fixed term appointment

A staff member who has a temporary appointment for a fixed term that is completed on the expiration date specified in the letter of appointment

43. When the performance of a staff member on a fixed term appointment does not reach an acceptable level, the Organization may decide not to renew the appointment.

In order to make a clear distinction between a fixed term and a continuing appointment, the Commission therefore agreed that there should be no time limits on the continuing appointment and that five year contractual arrangements should be covered under the fixed term category.

In the view of some members, an appointment of less than one year should not be included in the fixed term category.

However, staff above that age may be appointed on a short or fixed term appointment, if no other suitable candidate is available

A fixed term appointment is expected to be of at least one year's duration and for a period of up to five years.

(b) The Secretary General may terminate the appointment of a staff member with a fixed term appointment prior to the expiration date for any of the reasons specified in subparagraph (a) above, or for such other reason as may be specified in the letter of appointment

(c) Their fixed term appointment was terminated or not renewed on disciplinary grounds or owing to reasons specified in Staff Regulation 9.1 (a) or for such other reason as may be specified in their letter of appointment.

Appointment to the fixed term category is acquired through open and transparent selection procedures in accordance with the relevant staff regulations and rules of the organization.

OIOS noted that, in documenting a staff member s separation on retirement, departments were recording the action as a retirement , if the staff member held a permanent appointment on the separation date, or an expiration of appointment if the staff member held a fixed term or other non permanent appointment on that date.

(ii) A staff member who holds a probationary appointment or a fixed term appointment of one year or longer but less than three years shall be granted sick leave of up to three months on full salary and three months on half salary in any period of twelve consecutive months

By its very nature a continuing appointment could not have a defined duration and to provide for five year periods of renewal under that category would create an overlap with fixed term appointments.
