The Court of Appeal considered the evidence in respect of each appellant.

4.6 On 27 February 2001 the complainant lodged an appeal with the Aliens Appeals Board.

(c) They had access to remedies which proved to be effective in the case of Mrs. Aïcha Dhaouadi.

The author appealed to the Court of Appeal for Ontario.

With regard to the appeal, the authors claim that counsel who represented them before the Court of Appeal failed to consult with them before the appeal hearing, at which the authors were not present.

The Appeals Chamber held that the impugned decision was without interlocutory appeal and that it lacked jurisdiction to consider the Appellant's Notice of Appeal.9

The applicant did not appeal against this decision.

2.20 The author appealed to the Court of Appeal which upheld the conviction on 18 August 1999.

An appeal may be made within three months by the Prosecutor and will be examined by the Appeal Court in Cyangugu.

It quashed a number of the convictions against both appellants.

Plaintiff (respondent) commenced an action against defendant (appellant) and McElhanney.

The result of the author's conduct was that both the Appeals Court and the Court of Cassation were deprived of the ability to consider the merits of the appeal.

The Court of Appeal considered that the new evidence had no bearing on the matter in issue as defined by the appellant itself both in the lower courts and in its appeal factum.

In September 2002, the complainant filed a new application with the Aliens Appeals Board in which he asserted that an enforcement of the expulsion order would be inhumane.

2.4 The author appealed the judgement to the Court of Appeal, which affirmed the judgement on 26 June 1997.

The Court of Appeal of Jamaica dismissed the author apos s appeal on 22 May 1987.

The appellants then commenced action in the Singapore High Court.

2.7 On 4 January 2002, the complainant appealed against this judgement to the Bordeaux Administrative Court of Appeal.

If an appeal fails, appellants can challenge a police decision in the courts by way of judicial review.

2.6 On 24 October 2001, the Québec Court of Appeal dismissed the substantive appeals of the authors' corporation.

2.7 On appeal, the author was represented by a different legal aid lawyer, who allegedly did not inform the author about the date of the appeal, did not consult with him and conceded before the court that there were no merits in the appeal.

Although the author had confirmed that he wanted to be present at the appeal hearing, he was not informed about the date of the appeal until after it had been dismissed.

In the case of kidnapping, he has legal representation and may appeal to a higher court.

The author subsequently filed a new application for reconsideration and it too was rejected.

On 5 October 1990, the Court of Appeal rejected the author apos s request for release.

The Committee notes that it has indeed fully taken account of the Supreme Court's decision and is mindful of the analysis contained therein.

The Appeals Chamber and the pre appeal judge issued several pre appeal decisions and two decisions on motions for admission of additional evidence under rule 115 filed by the appellant.

After submitting his complaint to the Human Rights Committee, the author appealed to the President of the Court of Appeal, who is said to have replied that the administrative tribunal did not function in Togo, owing to the lack of qualified judges.

Since the complainant had made the request without the assistance of counsel, he was unable to appeal the decision to the Refugee Appeals Commission.

During the reporting period, it delivered four appeal judgements in respect of five persons.

Following postponement of the appeal hearings at the request of the appellant's counsel, the Appeals Chamber heard the parties' submissions on 7 March 2005 in Arusha.

As to the 5th appellant, the Court of Appeal found that he could not have expected to obtain a good arbitrage position' (as the appellant had so claimed) if the model was an outdated one.

6. The two men were prosecuted in 1995.

2.2 The author apos s appeal against his conviction was dismissed on 13 March 1989 by the Court of Appeal of Jamaica.

It therefore had to be ascertained whether or not the purported representative, who signed the complaint, was duly authorized to act on the complainant's behalf.

The Appeals Chamber decided five appeals from judgement, as well as 23 interlocutory appeals.

She appealed to the Paris Court of Appeal.

On 2 September 2002, the Aliens Appeals Board dismissed the appeal, endorsing the assessment made by the Migration Board.

2.6 The Court of Appeal of Trinidad and Tobago dismissed the author apos s appeal on 9 March 1987.

The Committee observes that, in respect of the first RRT decision which concentrated on his credibility, the complainant pursued no appeal to the Federal Court and has offered no explanation for his failure to do so.

Indeed, the complainant had successfully made such an appeal to the Limoges Administrative Court.
