VII. ILLEGAL AND PSEUDO LEGAL ADOPTIONS AIMING AT THE EXPLOITATION OF CHILDREN

(j) Under cover of a legal adoption but for other purposes.

The law prohibits child adoption, which is replaced by the system of caring for foundlings in accordance with the Foundling Care Act No. 107 of 1970.

Where an intercountry adoption is otherwise legitimate, the adoptive parents, in order to accelerate the process, often pay sums of money to intermediaries, people who are on the periphery of the arrangements of the adoption, such as doctors, lawyers or employees in orphanages.

Between 1 March and 1 April 2003, in accordance with the Interim regulations the Centre issued a uniform procedure for the registration of contact persons in China of foreign adoption organizations, so as to establish records of the contacts these organizations maintain in China and prevent unauthorized individuals from engaging in activities detrimental to children by pretending to work for a recognized organization.

The Adoption Act, as amended on 4 November 1998, combined the three documents previously necessary  the adoption registration, a written agreement and a notarized written agreement  into one single registration document, which served to strengthen the State's powers in the process and ensure protection of the child's rights through the involvement and oversight of government agencies.
