The first non paper, a proposed addition to draft article 18 in the form of an additional paragraph which would carry the number 5, addressed the issue of the delineation of the legal regime under the draft Convention and under international humanitarian law.

In terms of gender discrimination from customary laws, the draft Community Courts Bill, currently before Parliament would regulate the jurisdiction and powers of traditional tribunals to conform to the provisions of the Constitution.

Such a provision would enhance legal certainty regarding the scope of application of the draft convention.

Rule 7 of the draft rules of procedure contains provisions to similar effect.

As draft article 1 could be interpreted as stipulating that the rules of private international law governed the applicability of the convention, it would be redundant to include a provision with identical effect in draft article 18.
