By the end of December 1996, 720,900 had arrived in Rwanda, with more than half a million having returned during the first four days of the movement.

As regards the arrival and reception of Rwandan returnees from Zaire, the Human Rights Field Operation in Rwanda (HRFOR) reported that overall, the mass movement of returnees from the border to their home communes proceeded smoothly and that returnees were generally well received in their communes of origin.

In repatriation operations, measures to prevent separation were taken in countries of asylum and countries of origin, and protection and care mechanisms were put in place to meet the specific needs of unaccompanied and separated children before, during and upon their return.

18. Following the start of the massive influx of returnees from Zaire on 15 November 1996, the Government of Rwanda announced that occupants of houses and land belonging to arriving returnees would have 15 days to vacate such premises.

When and what to offset?

Progress in repatriation remains slow, because of the continued resistance by the hard line leadership of the armed groups and the persistent military tension and instability in the Kivus, which have significantly eroded the climate of confidence and security necessary to progress with voluntary disarmament, demobilization, repatriation, resettlement and reintegration.

By December, HRFOR had received reports that a total of 162 newly arrived returnees were in custody in local detention centres.

While the orderly and safe return of refugees to the Democratic Republic of Congo had been delayed by the actions of the Lord's Resistance Army in southern Sudan and the Democratic Republic of the Congo itself, UNHCR would be in a position to begin the repatriation of volunteer refugees from Kenya by the end of the year.

A well designed disarmament, demobilization and reintegration programme is in place and provides an important incentive, at least for lower and middle ranked LRA members.

43. On 5 November 1996, Melchior Bigirimana and Marc Sindayigaya, both from Muramvya province, and Leonidas Ndayishimiye, from Rutana province, all of them returnees from Zaire, were allegedly arrested by Captain Bashirahishize on arrival at Bujumbura, in the Rohero district.

The laws on abandoned property, in both the Federation and the Republika Srpska, contain provisions which are in contradiction with the Dayton Agreement and international standards, often hindering the right to voluntary return.

To date, the International Committee of the Red Cross (ICRC) has assisted 50 foreign former child combatants or children associated with the factions 11 from Côte d'Ivoire, 24 from Guinea and 15 from Sierra Leone to return to their countries of origin.
