The Council may, by special vote, recommend an amendment of this Agreement to members.

This Agreement may be amended when both Parties have agreed in writing to such amendment.

Developing countries argue that any amendment to the TRIPS agreement should not include the Chairman's statement.

The problem of the legal validity of the arbitration agreement would disappear in countries adopting the amendment to the MAL.

Adopting an amendment would be a lengthy process because it would take time for Parties to negotiate and reach agreement, and for the required number of ratifications to be obtained to enable the amendment to enter into force.

If this amendment were adopted, the question of the conclusion of the arbitration agreement and its content would become a problem of proof.

In this connection, the Committee recalls General Assembly resolution 59 176, in which the Assembly strongly urged States parties to accelerate their domestic ratification procedures with regard to the amendment and to notify the Secretary General expeditiously in writing of their agreement to the amendment.
