Judicial work of the Tribunal

During its seventeenth and eighteenth sessions, the Tribunal dealt with legal and judicial matters, including a review of the Rules and judicial procedures of the Tribunal.

The Registry of the Tribunal, with its Judicial Department and Administrative Department, has provided support to the expansion of the Tribunal apos s judicial and prosecutorial activities.

Cooperation between legal and judicial institutions in Croatia and the Tribunal has been good.

The Registry continues to support the judicial process by servicing the other branches of the Tribunal.

The Tribunal held two sessions devoted essentially to legal matters having a bearing on the judicial work of the Tribunal and other organizational and administrative matters.

43. The Tribunal at its fourth session also considered the resolution on the internal judicial practice pursuant to article 40 of the Rules of the Tribunal.

The Registry continues to support the judicial process by daily servicing the other organs of the Tribunal.

The Industrial Relations Court is a quasi judicial tribunal and does not follow strict rules of evidence.

Appointed as a Senior Legal Officer of the International Criminal Tribunal for Rwanda in Arusha, Tanzania, responsible for the overall management of the judicial aspects of the Tribunal.

With respect to the Waitangi Tribunal it was indicated that it was a quasi judicial body which had statutory authority.

The Registry continues its steadfast support for the judicial process by servicing the other organs of the Tribunal and the defence.

Mr. President, allow me now to briefly summarize the judicial activity of the Tribunal since the last report, submitted in May 2005.

To that end, all States should support and assist the International Tribunal for Rwanda and help to strengthen the Rwandan judicial system.

Even where a right of appeal is provided, the confirmation or otherwise of the sentence is not entrusted to a judicial tribunal.

During the seventeenth session of the Tribunal, the plenary of the Tribunal and the Committee on Rules and Judicial Practice discussed, on the basis of a document prepared by the Registry, the question of a code of conduct for counsel appearing before the Tribunal.

The Tribunal decided to hold its nineteenth session from 7 to 18 March 2005 to deal with legal matters having a bearing on the judicial work of the Tribunal and other organizational and administrative matters.

At the time of writing (August 2005), the Special Rapporteur is concerned about the judicial proceedings taking place before the Iraqi Special Tribunal.

The advisory function of the Tribunal is a significant innovation in the international judicial system, provided it can be given a broad interpretation.

61. The Registry is one of the three constituent organs of the Tribunal and is responsible for the Tribunal apos s administration as well as the establishment and servicing of the judicial infrastructure of the organization.

In less than four and a half years, the Tribunal has developed into a functioning international criminal judicial institution, the first of its kind.

During the eighteenth session, the plenary of the Tribunal and the Committee on Rules and Judicial Practice examined, on the basis of a document presented by the Registry, the issue of implementation of the decisions of the Tribunal.

The Rwanda Tribunal informed the Committee that it was drafting a manual of good practices which would be available for other United Nations judicial entities.

It was alleged by the source that the Military Tribunal has supplanted the civilian judicial process in trials involving human rights and pro democracy activities.

74. Another example of a judicial or quasi judicial mechanism is the Waitangi Tribunal, which is a body created on the basis of the Treaty of Waitangi in New Zealand to consider, among other matters, land claims of the Maori peoples.

1. Since the submission of the second annual report to the General Assembly, the judicial activities of the International Criminal Tribunal for Rwanda have increased substantially.

Such expansion of the judicial and prosecutorial activities of the Tribunal has been accompanied by a corresponding growth in its administrative infrastructure necessary to support this expansion.

9. Welcomes the development of the completion strategy, and invites the Tribunal to revise the strategy, where appropriate, to take into account the provisions of Security Council resolutions 1503 (2003) and 1512 (2003) and the resultant increased judicial capacity of the Tribunal

In the course of 2005, the Tribunal held its nineteenth and twentieth sessions, which were devoted to legal and judicial matters, as well as administrative and organizational issues.

21. The Chambers is the judicial organ of the Tribunal and is composed of 11 judges, 6 serving in the Trial Chambers and 5 in the Appeals Chamber.

20. Portugal declared that, in the absence of non judicial means for the settlement of disputes arising out of the application of the Convention, it would choose one of the following means for the settlement of disputes the International Tribunal for the Law of the Sea the International Court of Justice an arbitral tribunal or a special arbitral tribunal.

With the recruitment of a Deputy Registrar, the Judicial and Legal Services Division of the Registry now has the essential link required for the ongoing systemization of the function of judicial support to the chambers and the other parties in the proceedings before the Tribunal.

According to article 13 of the statute of the International Tribunal, as amended, ad litem judges of the Tribunal shall be persons of high moral character, impartiality and integrity who possess the qualifications required in their respective countries for appointment to the highest judicial offices.

By prosecuting several cases determined by the Tribunal to be based on the same factual scenarios under the same umbrella of a larger, single prosecution, multiple defendant trials are designed to increase the efficiency of the Tribunal while maintaining judicial fairness to the accused.

10. According to paragraph 1 of article 13 of the Statute of the International Tribunal, judges of the Tribunal shall be persons of high moral character, impartiality and integrity who possess the qualifications required in their respective countries for appointment to the highest judicial offices.

The terms of reference should enable it to enact measures and sanction violations like an independent judicial tribunal, and it should be capable of taking decisions and making recommendations.
