The Procurement Service is working together with the Department of Peacekeeping Operations to improve the skills and capacity of the peacekeeping missions in procurement and contract management.

The Registrar shall then determine whether to undertake a new solicitation, or to directly negotiate a procurement contract pursuant to rule 110.15, or to terminate or suspend the procurement action.

In the area of procurement and contract management, UNDP is committed to the four high priority recommendations of the Board.

The legal recognition of electronic communications arises in connection with the acceptance of tender and entry into force of procurement contract (article 36), and also raises issues of procurement contracts and electronic signatures.

The same Senior Legal Officer visited the Sudan in December 2004 to assist the Department of Peacekeeping Operations and the Procurement Service in contract negotiations.

Since the guidelines were apparently intended for suppliers rather than for procurement staff, they do not stipulate the ideal or generic qualifications required of procurement officials, desirable quality standards of the procurement process, or the responsibilities and modus operandi of contract review bodies, both at Headquarters and field duty stations.

As regards paragraph (6), it was noted that the second part of the paragraph addressed options available should the successful bidder fail to enter into a procurement contract.

In March 2003, the General Legal Division made a presentation on legal issues related to procurement, the United Nations General Conditions of Contract and other frequently raised legal issues at a conference in New York that had been arranged by the Procurement Service for senior procurement officers from peacekeeping missions, offices away from Headquarters and international tribunals.

Having considered the reports of the Secretary General on procurement and contract management for peacekeeping operations, and the related report of the Advisory Committee on Administrative and Budgetary Questions,

The Secretary General wishes to assure the General Assembly of the Secretariat's continued commitment to finding ways which will contribute to improving the procurement and contract management in peacekeeping missions.

Not only was there a performance risk, but also experience, particularly in the construction sector, indicated that businesses submitting abnormally low tenders subsequently tended to use all possible means to contest procurement proceedings and to improve the terms of the contract, with attendant upward pressure on the contract price.

Following the expression of interest notice for the construction contract, which was published on the United Nations procurement website and, for wider exposure, in the International Herald Tribune, 15 firms responded.

The recommendation was accepted by the Administration and revised rules for the Committee on Contract procedures based on the revised 2006 United Nations Procurement Manual, were implemented on 6 July 2006.
