Draft conclusions proposed by the Chair

The terms of reference for the seminar were prepared by the EGTT at its sixth meeting.

The SBSTA noted the progress on the implementation of various activities included in the work programme of the EGTT for 2005 and encouraged the EGTT to continue its good work.

The SBI encouraged the CGE to continue its collaboration with the Expert Group on Technology Transfer and the LEG in the implementation of its work programme.

An assignment is international if, at the time it is made, the places of business of the assignor and the assignee are in different States.

Conversely, some experts felt that the primary role of ODA was not to transfer technology but to create an enabling environment for such transfers.

After discussion, the Working Group decided that the law chosen by the parties under paragraph (1) should apply to both the assignment contract and the proprietary effects of the assignment.

The COP recalled its decisions 2 CP.7, 4 CP.7 and 29 CP.7 describing the mandates of the expert groups (the Consultative Group of Experts on National Communications from Parties not included in Annex I to the Convention, the Expert Group on Technology Transfer, and the Least Developed Countries Expert Group, respectively) and the support to be provided to them by the secretariat.

He said that the seminar's outcome will be considered by the EGTT and by the SBSTA.

It also noted that the EGTT will explore this issue further at its eighth meeting and will consider, for possible inclusion in its work programme for 2006, continuing to define and better understand the issues surrounding the transfer of publicly owned technologies and those in the public domain.

But the price of its dominance is enormous.

Some experts noted that Article 10A of the Montreal Protocol commits developed country parties to transfer technologies to beneficiary developing countries on fair and most favourable terms.

Concrete actions identified at the seminar include promoting synergy between the work programmes of the groups holding coordination meetings of the chairs of three expert groups (EGTT, CGE and LEG) and inviting representatives of the other groups to workshops and seminar organized by the EGTT.
