Yet another suggestion was that draft article 4 of the annex should provide that changes in the name of the assignor or in the title to the receivables should be registered.

The transfer of MOTAPM to States, which have not accepted the provisions and restrictions, as proposed in the present paper, should be prohibited.

While referring cases to the region, the Tribunal has been careful to ensure that a fair trial will be accorded to those defendants transferred and has placed an obligation upon the Prosecutor to provide regular reports to the Tribunal on the progress of the referred cases.

(p) Assignment means the creation of a security right in a receivable or the transfer of a receivable, whether the transfer is for security purposes or is an absolute outright transfer.

These Parties may decide to define a monetary value for the climate benefits achieved through such projects, and may further decide to transfer any portion thereof to any Party on mutually beneficial and agreed terms.

As between assignees of the same receivable from the same assignor, the priority of the right of an assignee in the assigned receivable is determined by the order in which data about the assignment are registered under section II of this annex, regardless of the time of transfer of the receivable. Other laws adopt a more expansive approach and give courts broad discretion to evaluate the circumstances of a particular case on the basis of specific guidelines.

The suggestion was made that thought could be given to a provision along the lines of draft article 77 of the draft instrument, which concerns the application of arbitration provisions to the holder of a negotiable transport document or a negotiable electronic transport record.

It was noted that paragraph (1) currently contained two options within square brackets under the first option, an assignment would be invalid if it was not effected in writing under the second option, the instrument of assignment itself did not need to be in writing, as long as the existence of the assignment could be evidenced by a writing, such as a list of receivables with the signature of the assignor or the financing contract document.
